How do I get my mothers house?
My mother lives by herself in a huge 3 bedroom house in Hampstead that she's been in since the late 1960s. It's a (Camden) council house. She unfortunately is an extremely agressive nasty person so I had to cut her out of my life a few years ago when I had my daughter. However, I would be really upset if the house that I grew up in was given to someone else upon her death, for finacial and sentimental reasons. There is no way she will hand it over to me, and she has no friends or family, is there anyway I can put her house in my name? Thankyou.

Look, I have a daughter and a disabled husband, and I'm trying to make my future a bit safer. I grew up in that house, and why should I be 'compassionate' to a woman who stabbed me. Some of you people are really stupid.

i can feel your frustration,its not fair when anyone who doesnt deserve to be housed gets housed.unfortunatly the house belongs to the council so you have no legal rights to it.

If the house is still a council house you can do nothing as it belongs to them.

What you are wanting to do is a very selfish one. You are trying to get something for nothing. She is your mother for god's sake have a little compassion. Nasty or not you will only ever have one mother time to make amends.

For a start, I think that the Right to Buy scheme in Camden only gives a £16,000 maximum discount, in line with most other London boroughs, so you are wrong in thinking that your mother's council house could be bought at a 60% discount. If your mother could afford to buy the house, and be persuaded to, and she left it to you in her will that could be one option. You or another family member could only do a joint purchase with her if you had been resident in the house for at least twelve months. The same applies to 'assigning' the tenancy, which is the only other way of passing on a council tenancy, but you and your family would have to have been living in the house for at least twelve months.

It looks like it's tough, but this is what council rules are. Having said that, especially if you have a disability within your family, there is nothing to be lost just by talking to the council to see if there are any loopholes, it could be that your mother has a hard-to-let property, or it could be kept empty awaiting upgrading so you might be able to negotiate a temporary let, it's a long shot I know but you won't find out till you've asked.

It is the council's property so you can't just 'inherit' it. To have the tennancy passed on to you, you would have to be living there and on the tennancy for a certain length of time before it would automatically become yours.

I'm sorry you have problems with your mum but I don't think you have any chance of getting the house at the moment. This house will go to a family who is probably in B&B at the moment and in desparate need. Selling council houses is a bad move and has led to the lack of affordable housing we have now.

ermmmm.......it's her house, you have no right to it unless she chooses to leave/give it to you.
You cut her out of your life so don't expect to be let back in.
Accept the consequences of your actions and live with it...who knows, her "mother's love" may still see her pass it down to you but i wouldn't hold your breath.

Two words come to mind......"Greedy" and "Unrealistic"

It belongs to Camden Council. They have a huge waiting list of people living in cardboard boxes who need a house like that. If you want it, you'll need to make the Council an offer they can't refuse.

Even if you could get your mothers house, could you sleep at night with the sound of her turning in her grave?

You cut her out of your life and therefore you cut her house out of your life.

Be greatful of what you have got or you yourself will turn out to be an old and nasty person that noone wants anything to do with.

In answer to your question (i belive you was asking about getting the property not the morale issues of your relationship with your mother like the other answers seem to be giving)

If your mother has not made a will, the law of intestacy will apply, therefore if you are the only relative you will receive her estate. If she has made a will, its wishes will be carried out, however you can contest it, but you will need to see a solicitor to do this.
If it is a council house, unless she has brought it on her death it will go back to the council in its entirety. You state she owns 60%. I find this had to believe as they dont tend to doi shared ownership or partial purchase on a council house. are you shaw that you are not getting confused with the ability for her to get a 40% discount on the purchase price?

mom owns the house, she can do whatever she wants with it and you have no say in the matter - she can will it to a stranger if she wants - don't count on anything, but you never know - there is nothing you can do to make her put it in your name

im really shocked that you would ask that question you cut this woman out of your life but yet expect her to just sign it over to you.. if anything happens to her she has no powers to do anything with the house it isnt hers its a council house how do you expect her to leave you something that isnt hers? the only way would be if you were living there.. if this woman is really as nasty as you say you cant have had a happy time living with her i think you need to grow up sorry. i am disgusted i dont always get on with my dad we clashed alot when i lived there.. he OWNS as in moved out worked hard and now has PAID for the house which is a huge 4 bed detatched with loadsa land and i have amazing memories and would love to bring my kids up there.. but i am not worried wether he leaves it to me my brothers or some random guy off the street.. its his property he does with it as he likes i didnt help earn it so in my eyes i have no rights to it also i would gladly give everything i owned to hold onto my dad for even an extra day... it does happen that i know what will happen with the house as we have no secrets but im not interested im making my own life for me and my kids and they will have happy memories where ever i bring them up.. grow up

She can leave the house to whom she wants but if she dies without leaving a will you will get it.
If she leaves it to the cats home or such like you can contest it and as her daughter you would win. Not all of it maybe but definitely a share as the courts see fit.

I know exactly how you feel. Looking at the answers most people gave, they don't quite understand what its like to be abused by a mother...or in my case a grandmother. You "cut" her out of your life to keep her anger and hatred away from your family and to protect them from her. Look up the laws for your state that pertain to wills and inheritance. From what I've read, your mother would have to create a will giving you the house. If there is no will, the house goes to her children (you). Since you said you were the only relative left, you may get the house by default. I would check just to make sure and it wouldn't hurt to get a lawyer either. Good luck!
