How do I get my security deposit back?
I moved out of a house in Tennessee a month and a half ago, and was told by the property management company that I would have either a deposit, or a list of damages from them within 30 days. They also agreed to mail a check for the prorated rent that was not used, since we moved in the middle of the month. (The lease was up already - so we were not breaking any agreements by doing that). Now it has been well past 30 days, and nothing from them. I have called three times in the past two weeks, and all three times they took a message, and never called me back. As I understand Tennessee law, they are not legally bound to stick to that 30 day limit, but I see no reason why they would give me a date if they had no interest in sticking to it. I think there was minimal damage to the house - a hole in the drywall from a doorknob which was repaired, but we didn't have the time to repaint it, and a handful of small items that I believe we may have left in the house. But nowhere near the $850 we gave them. What can I do to get these people to wake up and at least return my phone calls so I can find out what is going on?

unfortunately, we are now twelve hours away and going to the office to get the check is not an option.

Here is the basic law in regards to land lord returning deposit in TN. They may have changed a bit but you should get the jist of it. here. If you need more help contact the Tennessee Fair Housing Council at 1-800-254-2166

RETURN OF THE SECURITY DEPOSIT

If the landlord fails to deposit in a separate security deposit account, they may lose their right to hold those monies.

Within three (3) business days of the termination of occupancy but prior to any repairs or cleanup of the premises, the landlord shall inspect the premises and compile a comprehensive listing of any damage to the unit which is the basis for any charge against the security deposit and the estimated dollar cost of repairing such damage. The tenant shall then have the right to inspect the premises to ascertain the accuracy of such listing. The landlord and the tenant shall sign such listing, which signatures shall be conclusive evidence of the accuracy of such listing. If the tenant refuses to sign such listing, the tenant shall state specifically in writing the items on the list to which the tenant dissents, and shall sign such statement of dissent. If the tenant has moved or is otherwise inaccessible to the landlord, the landlord shall mail a copy of the listing of damages and estimated cost of repairs to the tenant at the tenant's last known mailing address.

The landlord also loses their rights should they not send the tenant a notice of damages or deductions.
GIVE YOUR OLD LANDLORD YOUR NEW MAILING ADDRESS OR YOU MAY LOSE SOME RIGHTS.
FAILURE TO RETURN THE SECURITY DEPOSIT
Notify the landlord, in writing, of their failure to return the deposit.

Should a tenant vacate the premises with unpaid rent due and owing, and without making a demand for return of deposit, the landlord may, after thirty (30) days, remove the deposit from the account and apply the deposit to the unpaid debt.

Check out TN law on return of deposits.
In many states, LL must notify tenant within 30 days of list of damages and return deposit or portion thereof within 45 days. Failure to notify tenant within 30 days can eliminate LLs right to deduct damages and make them liable to repay the deposit at double value.

After checking out the law, put it in writing to management, requesting return of deposit, noting that you were promised return of deposit or list of damages in 30 days--but did not receive it, noting that you called 3 times in two weeks and no return calls have been made, and that deposit has not been returned to you, although you provided forwarding address. Politely request immediate return of pro-rated rent and the deposit in acdord with state law.


DURRRECK
I had the same problem with my place. We called and called and they said they kept saying they would mail it in a few days. We eventually just had to go to the office and get the check.
