Jane | How do I get my security deposit back from my landlord? |
I was renting a backroom of a house.
When I moved in a contract was never signed because my landlord (my landlord does not own the house, she rents it) never thought it was necessary.
There was a verbal agreement for me to say 6 months, which I did.
When I gave my notice it was a verbal 30 day notice, she never asked for anything written.
It’s been well over a month since I moved out and my landlord has yet to return my security deposit and I know here in CA it’s supposed to be returned in 21 days..
Someone suggested I go to small claims to collect it.
The evidence I currently have is:
- Copies of all rent checks made out to my landlord with a note at the bottom that says FOR RENT.
- A copy of my security deposit check made out to my landlord with a note at the bottom that says SECURITY DEPOSIT
- E-mails between my landlord and I discussing the return of the security deposit in which she clearly states she will have it to me by a certain time.
- My new lease agreement showing I had moved into a new place the day I moved out of my old place.
Will this hold up in court or am I totally screwed because there was no written contract or notice? Can I sue her for my security deposit and damages?
Additional Details I don't have 'official' pictures of the room but I do have pictures in which you have a decent view of the place and you can see that it is not damaged. I also have 3 people that helped me moved out who are willing to testify that that place was in fine condition when I left and about 4 additional people who'd be willing to testify that I never trashed the place. |

As a California resident, I have some experience with this. It's the law for the landlord to submit an itemized list of the damages and costs to repair w/in 14 days of the tenant vacating the premises. If I were you I'd send here a letter asking for the itemized list (where the money was spent to restore the unit to original condition absent normal wear and tear) and give her 3 or 4 days to respond. Also place a note about 'no response will leave no other option but to file suit in small claims court' and attach the Ca Tenant law that requires the landlord to do this. Send it certified return receipt so you know she accepted the letter. Keep those receipts for your records.
Keep it civil and professional b/c if you do end up in court, you want to come across as a responsible person who tried to resolve the matter w/o intimidation.
Educate yourself on tenant rights. Google (Ca Tenant Rights). There are many FREE resources out there.
Good luck getting the S.D. back -- landlords often believe it's their bonus. |

Call the claims court and ask them if you have sufficient records. I think it should be, since she did take a deposit, she should honor it. Also, did you take any picturess to prove you didn't ruin anything? |

Dear Mr. Landlord:
As you know, I moved out of my apartment at 123 Tenant Road #1, Treelane, California on March 31, 2006.
Although I left the place clean, I still have not received my $500 deposit. As I am sure you know, the California Residential Landlord-Tenant Act requires you to either refund my entire deposit or give me an itemized statement of why it is being held within 21 days after I move.
The Act also states that if a landlord does not send the statement within 21 days the tenant is entitled to a complete refund. Also, if you intentionally failed to return my deposit or send me the statement, I can ask the court for double the amount of my deposit.
Please mail my $500 deposit to me at my new address: 456 Maple Drive, Dollar, WA 98001. If I do not receive your check within one week, I may file a lawsuit to recover my deposit. If this becomes necessary and I win, you may have to pay the costs of this lawsuit and attorney's fees.

In California, you can certrainly sue her in Small Claims court.
You may want to email or phone her one final time, saying if you don't get your security deposit back by a certain date, you will file a claim. Then follow through on it.
California also has help for low income people, if you can't afford the fee to file the small claims papers. The clerk at the county courthouse should be able to help you with the form, and they usually approve it on the spot. It can reduce the filing fees.
Copies of checks are great, especially if you have front/back copies that show that she deposited then.
The damages you can claim would be court fees, and possibly interest that would have been paid on the monies from the final date it was due to you (21 days after moving out). Possibly a judge may allow you to collect lost wages as well, though that one isn't a slam-dunk.
In the future though, always get a written lease agreement. It protects you just as much as your landlord. |

based on your info you are entitled to 100% of your security deposit returned. Since the "landlord" did not send you anything in writing telling you why or how much of the desposit was to be withheld then in small claims court the judge will award full refund to you -- based on it being more than 21 days.
The judge will also ask if both parties did everything possible to resolve this prior to going to court. So you should tell the landlord of your intention to go to small claims court and that the law will award 100% refond to you plus any other reimbursement you ask for on the forms you file -- like the filing fee, lost wages for the time off work to go to court, etc.
It would thne be cheaper for the landlord to just pay instead of losing the case in small claims court where the law is on your side. |

You have a legal verbal agreement,on paper would obviously have been more sensible.You would normally have to rely on the landlord being honest in order to get it back ( if there was no damage or missing items ),in your case you have the legal grounds for total recovery..There is ,however, the fact that your landlord is acting illegally by subletting,you should find out who owns the property and tell the landlord that you will snitch on her if she does not return your deposit. |

I would think so. Before suing though, (And spending even more $) I would suggest getting an attorney to send her a letter on his official letterhead, outlining the facts you stated above, and your intent to proceed with litigation if the deposit is not returned, seeking not only the deposit but further funds for pain and suffering/harassment. A good attorney should do this for a minimal fee, if not for free! |
