Probably a stupid question, but, is it possible to sell a house whilst there is a tennant living there on a short term (6 month) lease??

You need to get a hold of a copy of the contract you signed and read fine print and see if there are any loopholes.
I agree with you, the landlord might be lying to you, you need to make them show you exactly where it says you can't leave after your lease is up.
Take a person with experience down with you to confront this landlord. It sounds shady to me and like they are trying to take advantage of you.
You can't get out of a lease without paying but you are not responsible for paying for your partners half. |

Definitely get yourself a lawyer..or at least give one a call for a free consultation. I once went through the same thing before, I didn't have the money to afford a lawyer at the time,so I told my landlord that i had set up a meeting with a lawyer,( after speaking to one of course about the situation) it wasn't no more than a week that he released me from my lease. He was just wanting more money.. because he had no other potential renters at the time.. |

What papers do you have to sign when the lease is over?
The lease ending is the end of your obligation. If you continue to live in the apartment after the lease expires, then typically your agreement is considered month-to-month (check out your states rental laws).
If it's some type of consent for inspection or a release of your security deposit, that should have nothing to do with you moving out and getting a new apartment.

READ your lease, carefully.
If lease expires at end of October, you're done then. Give LL and old GF written notice ASAP. Should be 30 days (sometimes it's 60) in advance of date rent due, so well before October 1. You're right, if she wants to stay, she and LL sign a new lease. To get you off current lease, LL and she would have to agree, but once lease ends, you're done. You don't want to get a renewal or holdover, so written notice. If you already sent one, great. May want to send another rejecting LL's request that you sign new lease. |

Sign what papers? The only relevant paper is the lease. It's up at the end of October. You're willing to pay until then. Your obligation ends. Send him a notice now that you are moving out.
HOWEVER, your obligation for physical damages could last longer without a Move-Out Inspection. Plus you won't be able to get your security deposit until she is out. |

Sounds to me like the Landlord is trying to pull one over on you. Explain to him that you will satisfy the lease. Do this in writing and send first class mail so that he has to sign for the the letter. Explain that you will no longer reside at this residence. I think that the other tenant needs to sign a new lease at this time to stay.

No, that's not how it works, it sounds like your landlord is trying to scare you into paying. Just tell him you will not be renewing the lease. If your ex decides to stay there, then she would negotiate a new lease. Is your ex still living there? Can you ask her what she intends to do when the lease is up?
Try getting in contact with a tenants council in your city, they should have some good advice.
I would definitely send a registered mail (like the one they have to sign for, and you get the receipt) of your intent to not extend the lease. |

well you do have to send a notice to vacate before you move out, i think it is a law, and that's why your landlord wants you to sign the paper, however i do believe that you can submit a letter to your landlord stating that you are not returning, and sign it, especially if you are the head of house hold. but if you cant find your ex girl, or she wont sign it but she does want to move out.... i would forge it. lol.
so yes.... you do have to sign something before you move out... this might be stated in your "30" page lease.

The papers have been signed. Your landlord doesn't need any more signatures just a letter stating that you are moving out. at the end of october. My advice is get a lawyer. |

I went through this, so I know what your talking about very well.
You do have to get her to sign a new lease. It's just they way it goes.
She should be accommodating, but if she isn't going to do it you'll need to get a lawyer, and take her court - or at least serve her a subpoena to encourage her to sign the new lease before it gets to that point. I would hate to suggest that rout, but if she really will not sign the new lease, you have to protect yourself from being forced into paying for something that you shouldn't have to.
My girlfriend told me she signed the papers, and I trusted she did. It's important that you both go in together to do this, or that you have some proof that the papers were indeed signed. I wound up paying rent for another 1/2 lease including gas & electric for almost $6,000. I didn't find out I owed this money until I moved back to the city were we lived and tried to get an apartment on my own.

Once your lease is up all you have to do is sign move-out papers or a new lease to a new apt. My friend broke up with her boyfriend right before their lease was up and he signed a new lease to another apt and she just signed the move-out form to take her name off. If the apartment complex continues to give you trouble contact the corporate office if that doesn't work consult with an attorney to see what they recommend you do. Best of luck! |

Once you fulfill your contract with your landlord then that's it. Your landlord knows this. Look at the lease you signed and look at what you have to do to move out. Generally it says that you have to give written notice a month beforehand or something like that. Do that. You're right. |

If the lease expires next month then tell the landlord you are moving out and she will have to sign a new lease without you. You should not be held responsible for a new lease. Why wont' your roommate sign a new lease? You're correct if she wants to stay then she has to qualify for a new lease on her own. |
