My boyfriend and I share a place with our flatmate. He's disgusting. He has his own bathroom and I am pretty sure it's been cleaned once since we moved in [we've been here 6 months], his bedroom is filthy and he leaves his door open, causing the whole place to smell. We have a cleaning rota for the kitchen and living area and he never does it on his days, so we always end up doing double the work.
My problem with just kicking him out is that his name is also on the lease and we can't afford to pay the rent without him - Is there any way we can evict him and still make him pay his part of the rent?
I don't want to have to kick him out, but if the above was possible and we could get a letter off our landlord stating this it may make him shape up. I can't bear 6 more months [year lease] of this. Additional Details We have spoke to him about it countless times, he just had 2 days off work and slept until 4pm each day, before doing NO cleaning. |

Basically what you're asking -- to evict him yet still have him pay his part of the rent can't usually be done. First off you're a tenant, you can't evict anyone. The lease he signed is an agreement with the land lord, not the other tenants. The landlord would have to evict all the tenants, including you and your boyfriend. Now assume the landlord did agree to remove him from the lease (which is unlikely) he'd be gone but no longer responsible for his part of the rent. The only way to get the result you specify would be if the room mate left of his own accord -- that way he'd be gone but since he signed the lease and the land lord didn't release his obligation he is still responsible for his part of the rent. If you made the place "unlivable" to your flatmates point of view maybe he'll move out. The thing is if he moves out will he be able to pay his part of the rent (in addition to the rent of where he moves to) and will you be able to find him to sue him if he doesn't pay it? |

Your lease allows you the right to have a decent place to live. Try going to the landlord, (he's the only one who can legally evict him) Have him take a physical look at what you're talking about by giving a "surprise" inspection of your place and see if he has a remedy for you. If there is a structural eviction. He can be made to pay all his delinquent share, plus to pay up to the REASONABLE amount of time it takes to replace him with a better roommate.
Man! I feel for you guys. Having a stinking slob for a roommate stinks. |

I presume you have considered talking to him about it? If that didn't work, you could make it hell for him to stay there, but make sure he knows WHY you're making it hell for him - because he's making it hell for you. Does he have any girlfriends? Invite them over on his cleaning days, then chat with them about his habits! Spray heavy deodorant in his entire room when he is sleeping there, making sure to spray his face as well (ooops!), say you wouldn't have to do that if his room smelled 'nicer'... hope this gave you some ideas? And good luck, sounds like you're gonna need it!!!
Oh, you could also get five or six body builder friends come for a visit and threaten to use him as a mop to clean the place up - I'm sure he'll get the hint in a hurry (Aren't I bad???) ;) |
