I'm the only one on the mortgage. My income is the strongest so I'm the only one responsible for that. The only thing their name is on is the deed. The person won't just sign his name that's why I asked who can I do. Like someone stated it's an expensive lesson learned, but I'm willing to pay whatever it cost.

They sign the deed over to you, you do not really do anything.

If they are listed on your mortgage the mortgage company has to agree.

I believe your question lies in the fact what can you do when the person will not voluntary remove themselves from the deed? Sad to say pay them off in order to transfer title, only other recourse is suit in civil court of equity, but still they will receive just compensation for their part

Looks like you will be paying either way, expensive lesson learned, never place a partner on the deed unless you want them to have half equity

Generally you only need the other person to sign & notarize a "Quit Claim", which you would file with your county office. But, you will need the cooperation of the other person.
Is the person agreeable?
If the other person refuses, you will probably need legal representation.
Hmmm - I am surprised that the lender allowed for someone to be on the deed who is NOT on the mortgage.

If you want to remove someone from the deed they need to sign a quit claim deed giving you their interest in the property. If their name is also on the mortgage you may have to refinance in your name alone.

Did you use this person's income to qualify for the mortgage? Is this person a co-signer for your mortgage? They not only have the right to be on the title as a co-owner, it is required that they be on the title.

If they are not on the mortgage documents as one of the originators or a co-signer, then how did they get on the title? Depending on the reason they got on it in the first place, you may or may not be able to have simply simply sign a Quit Claim Deed to release any interest they may have ever had in the property to you.

If it's a spouse/ex-spouse or divorce in progress, your divorce attorney needs to negotiate title to the house as part of the property settlement.

If it's a matter of inheritance, it has to go through probate court.

You'd really better get an attorney on this since you clearly don't know (and didn't know) what the blinkety-blink you're doing here. You wouldn't be asking this if you hadn't messed up somewhere. Don't make a bigger mess!

The only way to remove them from the deed is to have them sign a "quit claim deed" to relinquish all their rights to the property. If they wont' sign then they won't get off the property.

Let me guess you allowed a b/f to go on the deed? Ya, my b/f at the time since we moved into my condo [I was on the deed with my father but not the mortgage] he wanted to be put on the deed so he didn't feel like a renter. Since my dad controlled everything he adamantly refused saying if you were married it would be different but if you break up he can force you buy his 1/2 or stake a claim when it sells. Thank God I took my fathers advice and dropped the subject because we broke up and I continued to live there for another 5 years after he left and when I sold I got a boat load of money in the sale.

The only way to remove them is by them signing off on the property to remove themselves sorry.

you only get your name on the deeds when the house is paid for, all you have to do is go and ask your mortgage lender to take the other persons name off the mortgage as long as you can prove you are capable of paying the full mortgage on your own
