Even though your lease ended several years ago, whatever provision were in it as far as notice still apply.
In most states and in most rental agreements, 30 day notice must be in writing and must be submitted before the start of the next month. In this case that would mean that you must submit notice before Jan 31 to vacate at the end of the next month. After Feb 1, 30 day notice does not take effect until the start of the NEXT month (ie March)
Look at it this way, since you think you gave notice on Jan 20, you are really only talking about basically the difference of a week (Sat 2/28 instead of Fri 2/20) Just give written notice today or tomorrow and move out at the end of February. |

Rent is almost always paid in advance. So for example, if you paid 1/1, you are payed until 2/1. Might want to get out the lease, it should tell you --- even if you are month to month. |

Security deposits aren't used for last months rent, they are to cover any damages you incur. You have to give 30 days notice, but some states require it by the 1st. You gave notice Jan 20th, which would be effective for February 1. If you leave February 20th, you will still owe all February rent. |

If you are required to give a 30 day notice the landlord may have a policy that all move outs are at the end of the month which is totally legal so you would be responsible for the entire month ecspecially if you are on a month to month agreement. Then again most places only allow a 3 month max for month to month leases. |

He is correct about the deposit - deposit is NOT rent.
There are 2 schools of thought on 30 days notice and prorated rent:
1. Some think like you that 30 days means 30 days and would prorate the rent.
2. Most take 30 days as 1 month notice and require the tenants to pay the next full months rent. This is what your landlord is asking.
Both are legal and it is purely up to the landlord what rout they will go. There is no legal guide line for choosing one over the other.
If they are requiring you to pay full Feb rent then you must pay or they can sue you. |

Since you are renting on a month to month basis, you need only give 30 days notice unless stated otherwise in your "lease".
You should prorate the rent (unfortunately, in this case, you have to divide the months rent by 28) times the remaining days which is actually the 19th.
Legally, he can not use the deposit to fulfill the obligation of rent unless it is agreed. From his point though, he would be taking your word that the property is in good shape. This is most likely why he won't use it that way.
Another point here is this. If you merely gave him verbal notice, he has the ability to misconstrue the timing, therefore allowing him to charge you to the end of the month. I realize it isn't fair but it happens.
If you rent again, you need to inform or notify by mail. I know it's a pain in the @ss but it helps to solidify your case should you end up in small claims court. Do not assume that won't happen as you already have a discrepancy as to how far you have to pay to.

To know what you owe for the remainder of the time you are going to be in the apartment, you pro-rate the rent by the days there are in the month. For example, get a calculator and divide the full amount of your rent between the 28 days there are in February. If you are planning to live half of the month of Feb, which is 14 days, take that daily rate and multiple it for the 14 days you are planning to stay in the apartment. That figure is the rent you owe him on February 1st. As far as the security deposit, that money is not to be used to "live it" in the apartment. Instead, the security deposit the landlord give to you when you move out and you give him the keys--because the landlord has to first see if there are no damages done by you in the apartment (other than normal wear and tear) and if there is a damage, landlord will deduct the cost to fix the damage from the security deposit. If there are no damages, landlord is supposed to give you back the entire security deposit. If there are no damages and he does not want to give you the securit deposit back, take him to court to small claims. (Make sure you take pictures of the apartment before you leave showing you left it in good condition with no damages to show a judge.) |

Rent is prorated. So for Feb, you owe him 20/28, or roughly two thirds of the monthly rate. You DO have to pay it, however. The damage deposit cannot be used in lieu of rent. |
