How do I legally get a family members out of my house?
My daughter and granddaughter live at my residence and have for over a year. I spend most of my time in California. My daughter seems to think that it is her home and she can do or say what gets done. It is my main residence, all utilities are in my name, I own the house (title in my name only) it is paid for. She has told my son and daughter-in-law that they can move in with her and her daughter. My son has three cats, one dog and 5 birds, she lets them stay in my room, cause she said "it is her house and she can let whom ever to stay in whatever room she choose. I have told her I don't want anyone staying in my room, she said " I don't have any say in the matter. She informs me that she is a tentant and she will take me to court, to stay in the house. The utilities are in my name, she does not pay any rent, she payes the utilities, the taxes, HOA,(Home Owners association) fees, and the current year Insurance. I also left over $4,000.00 in the joint account. Please give adv.

She is not a tenant if she does not pay rent. First of all, I would withdraw your money from that account before she gets her snotty little hands on it. Second, I would call the local law enforcement and see what you can do about removing her from your premises. She has no legal bearing if you have no contract and she pays no rent.

If you spend most of your time in another state, I would consider just selling the property so you don't have to deal with it. Otherwise, change the locks and rent it out to someone that will pay rent and respect your rules.

I'd take the $4,000 out of the account & close it. You'll have to file a formal eviction for all of them. You can get it done through you're county. They'll have 30 days to move EVERYTHING out. On the 30th day you can have a sheriff or police officer come out & remove them. They Sheriff can also serve her the papers. I would also turn off all the utilities. That will hopefully make her leave sooner.

Get your name off the joint account.

Give your daughter notice to move. If she doesn't move by the predetermined date, have all of her belongings moved out onto the curb and change the locks.

It is YOUR house and you have the right to have her removed.

You give her a 30 day eviction notice, if she doesnt leave, you call the cops. She cant take you to court to stay in the house, you can take her to court to get her out.

Have an attorney draft an eviction notice. That's all. If the paperwork is in order as you say, they shouldn't have a leg to stand on. You need to give them properly advanced notice (30 days or more, depends on the state), but once they are service that notice they are on the clock and have to find another place. They could file suit to try to block the eviction, but again if everything is as you say it shouldn't be a problem. If they don't vacate the premises by the reasonable date set forth in the eviction notice you can' have them forcibly removed.

Ca law states that if she is receiving mail their, it is her home to. You will have to go thru the proceedure of issuing a 3 day notice and take her to court, no other way around it, if you call the police, they will not make her leave.

I had to do this same thing only with a significant other (was not married). Go down to your local city or county courthouse where the residence in question is located at and file a petition for eviction and have it notarized which it will be if it is done in the courthouse. It will take a couple of days for the judge to grant the petition. Then she needs to be served with the eviction order. She has 30 from the date she is served and you should use a proof of service such as the sheriff's department for an extra fee which gives you the method to cover your butt should you need it for the judge. They usually will try to deliver it three times before they pretty much give up on it. Try to figure out when she is home most often and let the officer know. It will help get it done on the first or second try.

Then IF she does not leave, you can have the sheriff escort her off the property, change the locks and make a time available for her to get her things with the officer. You will need him/her there if you don't wish any more headaches then necessary. If that is the case the officer has the right to arrest her for trespassing, etc.

Also you need to give notice to the HOA and provide them a copy of the order of eviction in order to make sure they understand what is going on.

She has no legal right to occupy the residence. It will be easy for a judge or any court to give her a 72 hour eviction notice. If she fails to vacate, the sheriff in your town will remove her. STAND UP FOR YOURSELF, MOM. Take back what is yours!!!!!

Put a freeze on the account and send them a 30 day notice to get out!! You have no lease with them, so they have no right to stay if you give them notice to get out! Even if she were a tenant, you would have the right to say no pets!! How could you have raised someone so disrespectful and unappreciative? Then I'd get myself back there and make sure they don't tear the place apart for spite!!

You tell them to leave, you have ALL the authority, and legally she has none and no proof. If they do not, you can legally call the police and have them taken off your property. Simple as that.

well if she pays for all of that (& has proof it came from her money) she has a good fight in court since she is the one taking care of the house, but you are right the house is under your name...if you go to court one of you will end up paying the other money either her for the house , or you for the utilities unless the two of you had something writin say how thing will go. joint account is a joint account both and take and give all the money the want.....i would get your paper work together and talk to an lawery..well in TX that is how it goes..seen it done before

she is not a tentant and she has no right to let your son and his farm in your house....if it get mess to the point of court you will win...

but first just try to scary the hell out of her with policy and find a law in your state saying you can kick her out...

If she pays rent, you must follow the landlord/tenant ordinance in your state/city and evict her accordingly. If she does not pay you rent, I would suggest calling the police and asking their advice.

It's a bit extreme, but you could call the police. If she has no right son the house, no one there is paying anything and she isn't in any sort of contract, they are technically respassing.

She has no legal basis to stand on and would have a hard time finding a lawyer stupid enough to take her case.

What you can do in this situation is like most landlords is give a week, tell her that you are going to put her stuff out on the curb like most landlords do, and to grow up, and find a home of her own. You should also get it in writing that you are going to do this. Have her sign it, and take it to the bank, and get it notorize it, and or to your to your HOA talk to them to see what you can do as well.. If she doesn't like that than you can call the police. She legally can't do anything about it. Tell her go ahead, and take you to court since you will win anyways. The judge will be in your favor as it is. But make sure talk to your lawyer if you have one.
