I have friend that wants me to move in her apartment but she has 17 year old girl currently staying there that does not want to leave claiming "squatters rights" and is not even paying her any kind of rent or for utilities. Can't she just call the police since she is under age. How can she get this girl out of her apartment? |

Unless she has her parents permission to live there, she may not have a case. However, if she or anyone does have permission and has established a residence at an apartment or house, they may have rights and cannot be locked out or removed by the police. Someone cannot just show up at your house and say they are living there now. That's trespassing and they can be removed by the police. But if someone ALLOWED the party to stay at their place, and they established living quarters, than they have rights. What may further their case is receiving mail, having their possessions present in the house, and witnesses that know they have been living there or have been calling them there. It doesn't matter if they pay rent, utilities, or not. The law protects them and you or the landlord may have to go through an eviction process like any other tenant! if you illegally remove someone no matter how much of a squatter they are, you can be sued and perhaps forced to pay damages! When police are called, they basically go by the situation at hand. If someone is throwing someone out or locking them out and they claim that this is their residence and have no other place to live, than you could have trouble. Laws in the US prohibits persons from being thrown in the street from their primary residence unless due process has been served. |

I had to go through this with my friend as well, I wanted to move in where her creepy roomate was staying...If she has been there for more than 30 days, she's established residency. Unless something threatening happens, you cant kick her out too quickly. My friends roommate missed rent a month, and unfortunately, she STILL couldnt kick him out, it really depends on the laws in your area. I know for her she had to give him 30 days notice. My suggestion to you is go with your friend to the police station, and ask to casually speak to an officer or an official regaurding tenant laws in your area. Tell them your situation....
My suggestion is DONT do anything to sabotage her. She can and most likely will use that against you. If she is underage and not legally emancipated, it is illegal for her to be living there without a parent or guardian. Definetly go to your local police station, or call. Just get the stations number, dont just dial 911. |

If the 'squatter' is recieving mail there-then she cannot be kicked out without going through LEGALLY to have her evicted. In most states, if you recieve mail at a domicile, or pay utilities in your name-then that is your LEGAL residence and you cannot just boot them out! And it can take a couple months to do it-and she can stay there until the courts evict her.
Now, her age may be on your friends side...in most states, someone 17 cannot LEGALLY rent or lease property...if that is true in your state-then she can't 'legally' live there if it isn't with a relative-which means a complaint of trespassing can be served on her...so your friend can call the cops if neccessary, and ask them to stand by while you move the other girl's possessions out of the apartment. Change the locks, have the policeman explain to her that she will be charged with trespassing, and escort her off the premises. |

There is no such thing as squatter's rights here. She is not paying rent or upkeep. You could ask the landlord to change the locks. If she does not leave when you ask, you could also call the police and have here charged with trespassing. |

Your friend needs to contact the landlord or the police. She can explain the situation and ask the landlord to serve the squatter with a notice to quit the premises. If she doesn't leave, the police will escort her out. |
