You didn't 'inherit' a house if it's not in your name. While the deceased may have bequeathed the house to you, it belongs to the estate of the deceased UNTIL you have ownership transferred to your name. Once that is complete, THEN you will probably be able to get a HELOC on it. Not before. |

I'm guessing there might be court issues that may not be finished involving your inheritance and you might not yet have title ( ownership ) of the property. If you are working with an attorney involving the estate, you might petition the court to deed the property to you. Check with the attorneys. |

If you inherit it, you should put it in your name. I would go to the county office of deeds or titles and see what they can tell you. Many county office have forms but can't give you legal advice. If you fill the form and turn it in and do some research you can probably get the title transferred into your name, otherwise it's courts and lawyers. |

The executor or executrix can & should Quit Claim the property to the person(s) it was stated that should inherit it. That is part of the estate/will/probate process. If that is you, then you can do this Deed yourself. You sign in the estate or decendents name as the grantor & convey title to yourself. (or the personal representative for the estate signs) That Deed is then recorded at the county recorder's office.
You can then do what you wish as legal owner of the home. |
