just moved into ground floor apartment that we pay top dollar for (in our neck of the woods). My husband and i enjoy a smoke on the patio after dinner and i enjoy sitting out there with a book and a smoke now and again. Problem: 3rd floor neighbor is allergic to cigg smoke... has complained incessantly... accommodated him by now smoking 8 yards from our patio - but still, he complains about the smoke... i see that there will be no adequate solution but for either of us to move out... I can'r even enjoy my patio for the amount of money we pay for this place! I am soooo unhappy. Any advice anyone? |

There really isn't much the neighbor can do and the landlord can talk to you and maybe even have a cigarette with you but what you do in your home is your thing it would be impossible to create a health risk for other that far away. Maybe it's the car emissions they are allergic to and they should ask that the street in front of your place be closed to traffic.
Heck lucky for your neighbor that they don't live in the old west when they use to communicate with smoke signals. So they should be thankful.
As to getting out of your lease, now that could be harmful to your health. You could tell your neighbor to stop harassing you if you feel that your quiet enjoyment is being jeopardized, along with a copy of your complaint to your landlord and sit back and see the smoke rise from your neighbor's apartment. |

If you like your apartment, you should stay. It is not your fault they are allergic to smoke, and they should probably be living in a house or an area where they are not exposed to smoke. How is the smoke getting to them anyway...are they outside/are their windows open? They can take steps to make themselves more comfortable. If I were you I would have my smokes guilt free...it's not like you knew that when you moved in. |

First talk to your landlord, and the neighbor to see if a reasonable solution can be made (and by reasonable, I don't mean it's just good for your neighbor. See if you all can compromise about the situation). If that doesn't work, then look at the lease agreement and see what conditions apply if you chose to terminate the lease early. Will you have to pay a certain amount for the termination, will you lose your security deposit, etc. If it's not something that you are willing to deal with, then your neighbor really has no choice but to deal with it. It seems that you and your husband are being reasonable by smoking further away from the patio. You are being accomodating, and your landlord would have to take that into consideration if your neighbor keeps complaining. |

there are ways. heres some ideas> have a goon go knock on the door of the complaintant and sorta hint around about how much money he gets for different phases of his work.>smoke any way> have a huge party. maybe some bikers and some whores come by have the party in lawful hours wen disturbing the peace is not gonna werk.maybe 2-3 kegs. tap em in a bare dirt area if possible. for optimum tracking volume. what im saying is make em wanna cancell your lease. borrow a dog you know is gonna bark all nite. plug a drain .permenantly. so they must relocate you in the complex . or cancel the lease.you could maybe have the lease canceled if theres a question about the representation of the apt or a mis representation. you can even have people coming over and knocking on the door at all hours. traffic with no or short visits .means you are a drug dealer. read your contract.i always used to just move wen i wanted to. anyhow. |

talk to your land lord. Your neighbor can't do anything about it because he doesn't own the place. do you live in a inclosed apartment complex? If so, that's tough. If not, since you're smoking outside, he/she can't compalin about iit. If you want to move (which you don't have to because you're a rightfully paying tennant), then move, but if not, talk to your land lord about that neighbor. First he doesn't own the complex, second you're smoking outside. To terminate it, just say so?? I mean maybe you should've really thought about living there in the first place. Or help the land lord look for a possible new tennants? if anything you just have to pay ternimation fee or contract cancellation fee of some type. then you're free to go. Also, you don't have to help the landlords since that's there job, and people are always looking for places to live. |
