How do i get out of my lease, my husband and i cant afford the rent anymore.?
we cant afford our rent anymore and want to get out. there is like no loop hole to this lease and even if we tried to get evicted we would have to pay all the court fees because of this stupid lease. what do we do?

You need to talk to the landlord. Hopefully you are on good terms with them. With that being said some citys/counties have laws that govern your situation. Sometimes, not always, if you cannot afford the lease you should be able to get out of it without penatly. However, much of that may depend on the landlords ability to find a new renter. So if the rental market is strong in your area, which it may be, you could be in luck.

I don't believe any landlord really wants to make you break the bank if you can't pay the rent. In other words I don't think they will hold you to and sue you in court for the remaining time left on the lease.

If you are worried about being sued though I would check out what the limit in small claims court is in your state. In CA it is $7,000 or something like that. So at least you know if you are sued what the most would be the landlord could go after you for. But lets hope it doesn't go that far. Then you should call the court's small claims advisor and talk to them about the laws in your state.

If you explain to them that you just can't pay they should let you go. Not sure how your deposit would work- they may be able to keep that.

Be honest with them, but don't give them to many details. Bottom line is if you can't pay, you can't pay!

some places will let you pay a fee for breaking your lease but it might be several months rent.
Ask the manager or read what your lease agreement says.
Your lease is a legal binding contract.You will have to pay all court costs.
My question to you : What happened that all of a sudden you cannot afford the rent ?

First of all, talk to the landlord. I am a landlord and I am willing to work with tennants. For example, one guy done some work for his rent, and another left his deposit. Most people are reasonable, especially in this economy.

I believe just like in PA where I live, the most a landlord can make you pay is 2 months rent if you leave early.

talk to the landlord to tell them that you no longer can afford the rent and if he can start showing the place to find replacement tenants. Make it fair to everyone. If he were to go through the courts to evict you it will cost him money. Whatever you do, be honest and upfront and try to pay as much of the rent as you can.

It is kind of late in the game to realize that when you signed that lease you entered into a binding contract that is enforceable in a court of law.

See if the landlord will permit a sublease. If so you can offer the place cheap to someone who will live there and pay the rent (and just lose some of the money). Don't forget that you are still responsible for the payment so if that subleased tenant doesn't pay then you are up the same creek again. Don't get a tenant who will say someday "i cant afford the rent anymore."

of course there is no loophole ... the landlord's attorney wrote the lease.

read your state's law on tenancy. google will find it.

most are pretty simple and some limit what the landlord can do or charge when you leave early.

then tell the landlord. he'd like to know at least 30 days in advance. if you're lucky, he'll be understanding. if he isn't, you'll at least know what the limit is of what he can actually do.

Some places don't allow subletting. See if you can maybe transfer to a less expensive apartment.

I'm curious as to what changed that you could afford it when you moved in but can't now....that is the question I ask people that rent from me.

If one of you lost their job, then the other needs to get TWO until the other one can find a job.

The CHEAPEST thing you can do is stick it out until the lease ends and then move...you'll save money, stress, and your credit.
