How do i get these non-paying tenants out?
i rented my house through an agent 18months ago.the tenants paid for the whole six months up front and one months deposit.the agents were useless and at the end of the 6 mths i sacked the agents and the tenants started to pay their rent direct to me.at the same time the agents dissapeared (with the deposit).anyway the tenant has been ok for the last year (not great,rent regularly 2-5 days late),anyway now its 16 days late ,and they are avoiding my calls and texts.
however there is no point going to the hose as the tenants have never lived there ,some other people live there (subtenants),i think these people are workers of the brother and sister who rented the house.i have always known about the subtenats ,but while my rent was paid it did'nt bother me.there is no tenancy agreement in place after the original 6 months.i am a bit confused what to do next.however i think since they are playing silly plonkers by not letting me know whats happenning,i just want everyone out.any advice ?

Personally, I would get a crowd of mates and go 'round and throw their stuff out and move mine in and take it from there. pity you can't find the agent, you could have sued him on a duty of care order. No tenancy agreement?, then they must be trespassing.

by law as there is no tenancy agreement in force all you have to do is serve a notice to quit

giving them 28 days to vacate the property

after that time you can apply for a court order to remove them from the property

to check this information just go to the citizens advice bureau
by lawful force ie bailiffs of the court

You should have written up & both parties sign a rental agreement, when you first rented the place out.

Since you don't have an agreement with the current occupants you can write something up, approach them in a nice manner & see if they are willing to sign.

If you want to evict them I would suggest you hire a person that serves eviction notices for a living. These are usually the same people that serve divorce papers & such.
You might want to get a book on, "The Responsibilities of a Landlord".

They could be using the house as a "crack" house and you would be in big trouble if the law finds out.

A lot depends on where you live. For example, I owned a coop in New York City which I was renting. I had one bad tenant over 15 years of owning the unit. That bad tenant was impossible to get out however. The NYC laws are totally skewed toward the tenant and away from the Landlord. NYC has a special court for disputes called tenant/landlord court. I took my non-paying tenant to this court and won (took 4 months for the trial to happen). However.....The Judge told the tenant to pay me and gave him an additional 4 months to get out. I never received the payment, nor rent for the additional 4 months and had to get a judgment to get a city marshal involved to start the eviction (which took another 3 months). I got him out, but lost close to a year in rent which I never received.

Anyway, the sooner you start proceedings, the sooner you can hope to get rid of them.

Go to civil court, file the papers , and the authorities will toss them out after 30 days.

send them a hand written letter of you,and get another person to sign it to prove that it had been written,and then don't post it through the door hand deliver it in person,or check this site out it gives you landlord rights, WWW.RPTS.GOV.UK,this should tell you the best advice to do, or try WWW.DIRECT.GOV.UK, again this helps landlords with help and advice with problem tenants. hope these have helped you abit,and you soon get it sorted out. good luck.

I suggest going to the house and leaving a notice on the door, let them know that you will begin eviction proceedings if you do not have the rent on the next business day.

Give them notice ( 28 days ) to vacate , if they do not leave then you can take legal action to remove them

Your best bet is to take legal advise

The council housing are good at giving advice- we spoke to them about rights etc. You have to go about things in the right way or they can end up staying longer
Just saw above post- do not try to kick them out without advice!1
without a leace they have statatory tenant rights- thats where we were caught out!! We needed to give a 6 month leace with notice to make it all legal- they have so many rights if you dont have a lease to crack down on dodgie land lords. Good luck

Just kick them out, since there is no lease you have the power to evict them whenever.

Why don't you approach the 'sub- tenents' that are living in the actual house about renting from YOU? Since you are, after all, their landlord. That way, they are paying directly to you and not to your tenents that are not paying their rent. Cut out the middle man.
