How do you fight an eviction?
My landlord wants to move me out to move in illegals. I have a year lease and have done nothing wrong. What can I do? He even offered to pay me 600.00 to move out asap. Is this right?

He has to honor the lease, but if your lease is up (you are month to month now) he does have the right to have you leave. But he would have to give a written notice and you would be given 30 to 90 days from the notice depending on what state you live in.

So, I would work with him and move, get as much money from him that you can (he is not required to give you anything) So maybe go with paying you the $600 and last month rent free. That would give you 30 days to find a new place and the $600+ your last months rent free for a down payment on a new place.

Why would you want to live under a landlord like that?

I think if you have signed a contract lease for the whole year, he can't evict you! In fact you can even sue him for breach of contract if he throws you out.

To legally evict you he will have to take you to court. When you get the court notice, go to court and explain to a judge why the eviction is wrong.

But why would you want to live someplace where you arent wanted? I'd take the six hundred dollar offer and pack my bags.

Morally no... but the law may give him some rights too. I would contact a lawyer, or free legal aid where you live and see if something can be done. You might tell him you would move for more money.... not $600, but maybe $1500.

If you have a signed lease and you have been paying rent, it should be very difficult for him to evict you.

As far as fighting, you could use nunchaku or good quality fighting swords. Are your experienced in battle?

Nope. Most landlords make you pay *them* if you break a lease. Make sure you have a copy of your lease and read through it. If you have any proof of the bribe, keep it on-hand. If he tries anything, like physically trying to remove you, or even the continued harrassment, call the police and show them your lease and anything else that may help. If he does have a reason to evict you, he has to give you at least 30 days.

**But, that doesn't sound like a person you'd want to be dealing with anyways.

I would consult a lawyer with a copy of the lease agreement, usually consultation are inexpensive or free and they can give you proper advice.

If you have a lease, you have an interest in the land, and he cannot extinguish that without compensation. So, he can trump up lots of BS to fine you for, and take your security deposit, and call the cops for noise complaints until he paints you as a nuisance and evicts. but, he cannot simply tell you to leave.
Having said that, I would take the money and run. then, I would report him. Bargain for more money.
If he told you to leave, and you took him to court, the court would say your right trumps his.

What State do you live in? What does your contract say? Is your landlord willing to give you a notarized letter releasing you from the contract? YOUR LANDLORD HAS TO HAS TO SERVE YOU WITH A 24HRS OR 3DAYS NOTICE DEPENDING ON YOUR CONTRACT, ON DAY 4 YOUR LANDLORD HAS TO FILE AN EVICTION, THE COURT DATE WILL BE SET AT THAT TIME. YOU CAN STAY IN THE APT/HOUSE THIS ENTIRE TIME. WHEN YOU GO TO COURT, THE JUDGE WILL ASK "DO YOU HAVE A LEGAL REASON FOR NONPAYMENT OF RENT?". (IF THIS IS NOT A RENT PAYMENT ISSUE, THE LANDLORD MUST BE REPRESENTED BY A LAWYER.) IF THE LANDLORD GETS THE JUDGEMENT, YOU WILL HAVE FIVE BUSINESS DAYS TO MOVE OUT. ON DAY 6 IF YOU ARE STILL THERE, THE LANDLORD HAS TO FILE A WRIT. THEN YOU HAVE 24HRS TO GET OUT AFTER YOU HAVE BEEN SERVED. REGARDLESS, YOU CAN STAY IN THE APT UNTIL THIS PROCESS IS COMPLETE. YOU ARE LEGALLY RESPONSIBLE FOR THE RENT UNTIL THE END OF THE CONTRACT, INCLUDING RELETTING FEES, DAMAGES, DISCOUNTS, 30-60 DAYS NOTICE, ETC. READ YOU CONTRACT AND CALL LEGAL AIDE IN YOUR AREA.
