One way to do it is with a system that has both REWARDS and PENALTIES. An example:
Situation:
The tennant pays the rent ten days before it is due.
Reward: $100 discount on rent
Situation: The rent is more than five days late
Penalty: $50/day after five days (ten days late would be $250). |

as a landlord you make your place invaluable in quality, price, and service calls.. they will not want to leave your place.. therefore paying rent to avoid eviction.. Usually nice places that have great rent prices are very hard to come by.. so when a person gets in.. they make sure they dont mess up because they know there is a list of ppl waiting to rent from you. |

As a landlord myself, I found that charging a late fee didn't help much. They don't care, they'll just pay the charges. In the meantime your struggling to make your expenses on time because they haven't paid. I now offer a discount of $25 when they pay on or before the day the rent is due. For the most part I can now count on having my rent on the 1st because they want that discount. |

First you can either serve them or tape to the front door a 3-day notice to pay or quit.
Second, after the notice,serve them with eviction papers where they have 5 days to respond to the court. If they respond you will be notified, if they don't then a hearing date is set and each party must appear. The judge will hear both sides and determine who he believes is telling the truth. If you win, they will have to move out but there is no guarantee of getting the money owed to you. You may have to garnish their wages. |

Get a lawyer to send them a legal notice that the rent must be paid by x date or late fees of $x will be imposed . If it is not paid by then, you will begin eviction proceedings. If the tenants continue to not pay, evict them. |

Impose a late fee and eviction clause in their lease. If they have a long-term lease in place without these, then evict them. It will take 90 days to get them out, during which you will receive no rent. Even if you impose the late fees, they likely will not pay them. If the units all have separate utilities (electric/water/etc.), you may want to "create problems" with those connections. They probably will not want to stay if they have no heat, air, hot water, septic, etc. |

Evictions and collections are very expensive, but that might be your only choice at this point. Thinking constructively and thinking ahead, you can plan a way to attract better tenants. this might mean changing the way you check references and credit. Changing the way you advertise your vacancies and perhaps making some changes to the property itself. Check around to see if your town or county has a rental property owners association. Join it and participate in it if there is one. You can get a lot of information, forms, advice, and support from other property owners. Business planning is the key to success and having rental property is a business. |

First of all your rental agreement should have provisions for no grace period, rent becomes delinquent the day after it is due with a $50 late fee and $5 for each additional day. $50 for every partial payment. $50 for every bounced check. Filing fees for every time eviction is started. Then go file each time the rent is 1 day late - you will be able to collect the fees and it will either get them to take you seriously or proceed with the process. It really is worth a visit to an attorney to get your ts crossed and i doted. |

if they still wont pay on time evict them. simple.

You wait till they leave and then change to locks or call the cops and have them arrested. Kick them out!!!!! Better yet tell them that if you don't have it within 24hrs you will advertise it for sale or have it demolished. |

I looked at renting one house out and read up on Landlord/Tenants rights and regulation.
There are hoops to jump such as written notices that have to be notarized in some cases,then you give notice of eviction..but if they come up with the money you can't technically serve it...lots of BS..i'm selling the house instead.
Renters seem to have more "rights" than owners.Check your local laws. |
