How do you kick someone out who doesn't pay rent??
I live with my boyfriend, and his 21 yr-old son lives with us. He hasn't had a job for 1.5 yrs and hasn't paid rent. Lately he has been really rude, coming into our bedroom when we're not there and taking stuff. It's become where we don't even like going downstairs anymore. He doesn't listen to our rules - basically we want him gone. But he never leaves - so we couldn't just lock him out. He also has no car or job to fall back on. How do we get him out?? What are our options?? He's not on our lease so that's one less thing to worry about, but it's at the point where we would literally have to drag him out of the house. Please - any comments would be extremely helpful!! Thank you!

Are you asking how to evict someone? That sounds like a ridiculous way to resolve your boyfriend's poor parenting.

First, you probably have to legally evict your boyfriend's son. You and your boyfriend authorized the son to live there so you can't have the police solve your boyfriend's parenting problem. The son did not break any laws and is a legal resident. Give the son a 30-day no cause move-out notice, then you can go through the legal eviction process which will cost $75-100 and take another several weeks to complete. You can expedite the son's removal if he is violent or causes damage.

Here is some unsoliticited family advice: The son is your boyfriend's problem -- not your's. You agreed to live with a man who had a grown son living with him. If I were you, I would stay out of the situation and let your boyfriend deal with it. It's your boyfriend's responsibility to parent his son into a self-sufficient adult. To avoid family turmoil, I would have the boyfriend offer his son a few month's rent for a room rental and other expenses to entice the son out.

I was watching COPS, they were in Alaska. The gf kicked her bf out of the house bc he was cheating. The bf called the cops complaining he got kicked out, his stuff was in the dumpter, etc. She explained why she kicked him out, etc. To my surprise, the cop told her per Alaska Law, she had to have him evicted by court order, even tho he wasnt paying rent! He explained that it was his place of residency and the courts wouldnt care if he paid rent or wasn't on the lease. So she had to go to court and file the eviciton. I'm not sure if that law would apply to your state, but you can find out.
Call the cops to see what your evcitions process is in your state.

Yeah, I saw that cops episode that the other person mentioned. The fact that he lives there with you may entitle him to some rights. If I were you, I would consult an attorney before you make any moves as anything that has to do with living situations can be very litagous. There could be some procedures that need to be followed according to your state. If your funds are low, a local law school may have a working clinic you can get free advise or call an apartment association for your state or the Department of Fair Housing. Here in CA we have the California Apartment Association.

Give him taxi fare to a temp agency to apply for work. Put all of his stuff out on the lawn, have the locks changed.

You will have to evict him legally if he refuses to leave on his own. The police wont force him out, it is considered a civil matter.

Hmm.......you say it's your boyfriends son.......All you can do is voice your opinion to your boyfriend and it will be up to him to have HIS son move out unless you are willing to give up this relationship. Personally if it was my son I'd make some rules but never kick my kid out and make him homeless.......no matter what my other half said. Y'all need to sit down and talk to his son because there may be issues there noone knows about.....ie.....depression.....drugs...... I really do hope your little unit finds a solution that makes the whole family happy and secure.

His dad needs to sit him down and tell him he has two weeks (you don't want to really ruin a relationship--when his son MATURES he'll want to have a real relationship) to find himself a place to live and he better have a job to support himself because Dad is NOT going to be subsidizing an apartment.
Then Dad needs to follow through. At 21 the kid has NO right to be in the house--he's not on the title and he's not paying rent and there is no legal obligation to do squat for him. You could even call the cops and have him hauled out for trespassing.

Do you think the kid is on drugs that's lazy and rude? He may well need some rehab, but again, as an adult, that's not YOUR problem, it's his. Just strikes me as a real possibility.

Good luck. This will be VERY painful but it should have been done 1.5 years ago.

You simply tell him to go, watch him pack his things (or pack them for him), take the things outside, and hopefully he'll go with them. If not, then you can contact the law to physically remove him.

It's your home, you have the right not to have anyone there that you do not want...especially if he's not on your lease or mortgage (so has no "ownership" rights).

I do like the other people's answers - just make him leave, change the locks. BUT, if you want to be a little nicer than dragging him out the house give him an official 30 days notice. This will also help you if he calls the cops and claims that you tried to lock him out of his own house (the legality of it depends on your state, even if he's not on the lease he may actually be right in this case, since he lives there you technically have to evict him and cannot just lock him out).

So tell him you want him to move out. That he has 30 days to find a job and another place to live. Give him notice in writing. Keep a copy for yourself. Remind him of this several times throughout the month. Then when the day comes, tell him he has to leave now. Then change the locks.
