How do you legally evict someone from a property when there is no rental agreement and they don't pay rent?
We are in Tennessee. When my husband and his exwife got divorced he moved in to another house. The house they were living in together belongs to his grandfather but is on my husbands property. When they got divorced my husband and his grandfather told his ex that she could stay there long enough for her to get on her feet and pay no rent. Well it's been a year and a half and she is making no attempts to leave so everyone involved agreed that it is time to tell her that she has to leave. How do you evict someone you've just let live in the house?

Give her a 30 day notice that the verbal contract is terminating. If she does not leave, you can proceed with eviction through the court system.

The same way you would evict someone who has a lease and does not pay. Read your local landlord/tenant laws for the exact procedure.

Give them a 30 day written notice ( I would send it registered mail) stating they have 30 days to move out and if they fail to do so, the eviction process will begin. Then you may have to file eviction paperwork and get the police to come and physically remove them and their belongings out.

Just give a 30 day written notice like you would any other tenant. If she doesn't leave in the 30 days proceed through a district justice. It will take time but she will have to get out.

just file a small claims eviction, AFTER you give her written notice to leave (at least 30 days). Then in small claims court, the Judge will either believe your husband or his ex about what kind of agreement they had.

You made a verbal contract to allow her to live there rent-free "long enough for her to get on her feet". You didn't specify that she had to actively attempt to get on her feet and you didn't set any time limit so, legally, she may be entitled to live there as long as she likes.

Contact an attorney. If you take her to court, and she makes her case, she may end up with a life estate (legal permission to stay in the house as long as she lives).

Wait til shes sleeping and slowly and quietly jack the house up high enough to slide her bed out with her in it. Quickly but remembering to be quiet jack the house back down and change the door locks. She'll be surprized in the morning...LOL

Nah dont do that its hard to be quiet, just go down to the county and start eviction proceedings, Im not sure of the steps but i am sure that you can evict her just like a tennant maybe sooner with no lease, its your house. Evictions can take several month i've heard 8 to 10 months at times so asking her to be cooperative may help things. Ofcourse if shes nasty you maybe able to call the police and have her removed with no lease, i'd start on the town or the county level and start asking questions.

give her a written notice, notarized and everything. give her like a month or so. then if still nothing, i say you just go over there one day w/ cops and kick her out. or put all her stuff outside and change the locks. what's she gonna do?

Are there children involved?If so,your husband may have a problem.Seek legal advice.

You do not have to evict her if there is no rental agreement. call the police and have her removed fort trespassing.
