So three years ago my husband put a house in his name for his sister and her family. Unfortunately, he couldn't say no as his mom pressured him and his sister has kids. Well, three years later we want to buy a house, but due to debt-to-income he can't get a loan. His mom did his taxes for years and never put the house on his taxes as he would've owed. His sister can't get the house in her husbands name because he had a car repo'd years ago and even though it's old, the bank won't give him a loan (so she says). He also had his tax return taken from him two years ago due to not paying his student loans and he up until a year ago had no revolving credit. My husbands parents just bought a house, but were only approved for $150k. After the dust settles from their home purchase they want to put my husband's sister's house in their name (why didn't they do this before...). This has affected us so bad because we're forced to rent and he had to buy a new car due to debt-to-income. Everytime I log on to our bank account I'm forced to look at the mortgage. It has put a lot of stress on our relationship too. We want to buy a house next year but don't know what to do. We even have money saved. Any suggestions??? Additional Details His mom hasn't been putting any of the information on the taxes so I don't see how that's fraud. His sister pays the mortgage on time every month but it has never been documented as rental property. It's as if he lives there but doesn't technically. His parents want to refinance it as soon as they can but I don't see how that's possible as they were only qualified for a 150k home and their new home they just purchased was 118k. He was 23 at the time not that age has anything to do with it. |

Your husband put a mortgage in his name for a home he doesn't live in, but that his sister and her family live in. Is the sister paying rent or making the mortgage payments? If there is rent then that can be documented to offset the mortgage. If your husband has been writing off the mortgage interest but not declaring the rent, then that is tax fraud. These things come back to bite you eventually.
His parent's can not just put their name instead of your husband's name on the mortgage. Mortgage companies don't let people just change who is on the contract. His parents will have to refinance the house, and do so as if it were a rental (higher insurance) if they are going to rent/give it to the sisters family. Your husband must also have insurance on the house as if he and you were living there. If something happens to the home, the insurance is not going to pay if they know the house is being rented.
Oh, what a tangled web ... Not a thing you can do other than force the sale of the house if someone doesn't refinance it. You should give them written notice that they are tenants and therefore you give them 30 days notice to move. Your husband has jeopardized his own financial well being through this mortgage and insurance fraud. Financing a house for someone that even the banks won't loan to is just too risky. That family needs to go rent a small apartment that they can afford.
Sorry you are in this situation. Time to say "no" to letting husband's mother call the shots on what you and your husband do with your finances. Seems he needs to man up and look out for his own immediate family, and let sis and her husband work out their finances. Good Luck. |

Well there's not really a whole lot that can be done. Your husband made a very bad decision putting himself on that note & that's pretty much that. If he's the only one on the note & the only one on title he can sell it & they can buy it basically but it doesn't sound like that's going to be possible. So either the sister and husband find a way to refinance or the parents purchase the property which also doesn't sound possible. So he's going to have to give his sister & her husband enough time to pull this together & give them a date to get it accomplished before selling it. Having a car repossessed doesn't not disqualify someone for getting a loan. They need to actively work on rebuilding their credit & do the homework themselves. All your husband needs is to be bought out & leave it that. It's on their end to figure out how to accomplish that. He needs to have a serious conversation with them to put it in motion. It's not going to happen overnight but if they want to own their own home they will need to rebuild credit, save money, and find some contacts that will help them with this. Your husband just needs to lay it all out & tell them that they are going to have to find another way & then leave it to them to do so. Period. |
