a forcible retainer judgment You take that to the sheriff
who will visit the rented unit and either remove the tenant,
or if they are out.......for whatever reason, you
change keys, remove and STORE ALL THEIR GOODS
and you have your unit back without non-paying tenant.
Excluding the military, landlords cannot take preemptive
action on what people say. |

READ the lease agreement. Minute they're late, serve them with eviction notice, whatever your state requires, 3,5, `10 day notice. File suit to evict them. Delaying makes it take longer to get rid of them. No written lease, same deal, no rent by today for October, serve them. |

First, the tenants have to fail to pay. Once that happens all you can do is follow the law and evict through the courts.
You need to know the landlord tenant laws and eviction procedures for your state. The laws and procedures vary from state to state, so without knowing your exact location, no one can really give you a definite answer.
You need to know if your state allows a grace period for rent to be paid - some do.
Once the rent is legally late, you need to find out exactly what type of notice is required in your state. Some require a Notice to Pay or Quit, others are just a Notice to Quit. The Notice will require a specific number of days in which the tenant must pay in full or vacate. The number of days varies greatly from state to state.
Once the specified number of days are up per the Notice, if the tenant has not paid or moved out, you would need to file for an eviction (summary, UD, etc).
You can do an eviction on your own, but must be very careful in filling out the paperwork and forms. One simple mistake could lead to a dismissal of the case and you would have to start over.
I highly recommend using an attorney, but if you know someone that has been through the process and can guide you, that will do too. Evictions by an attorney cost $700.00 for basic non-payment in my area, though the costs varies greatly by location.
A non-payment eviction takes between 4-6 weeks, but it can be dragged out in some states if the tenant pays the rent owed on or before the court date.

You should give them written notice in front of a witness, a week should be more than enough, to demonstrate to a court or law enforcement person that you were reasonable. Try to write something businesslike, i.e., without rancor.
Technically, of course, especially if you think they might damage your home or commit a bit of larceny on their way out, you can put their stuff on the front lawn and change the locks (if they have keys). Don't start removing their stuff when they're around or if you expect rain.
The police won't give you legal advice, but if you don't have anything in writing showing some kind of rental agreement, your friends don't have a leg to stand on.
Whatever you do, don't start a breach of the peace, or you may end up in the same holding cell together for the night. |

As a landlord, you can serve them with a 3 day notice of eviction. Beyond that, you must hire an attorney to get them out. Evicting people is not a DIY project, and follows a certain prescribed method that has to be followed to the letter ~ I know it's not what you wanted to hear, but hiring an attorney is the easiest and fastest way to deal with this. Evicting someone can take up to 6 months so it's best you get started ASAP.

after 30 days of non-payment you can assess them a late fee. it varies state by state as to how long you need to wait before you can give them an eviction letter. check the lease - it should have that outlined though.... |
