What you are trying to do is illegal. You can NOT give your notice and then NOT pay your rent. You also can NOT use your deposit as rent...if that's what your trying to pull.
The 5 day notice is the first step in the eviction process. If you fail to pay, the landlord will proceed to court. He may or may not be able to get you out before the 1st, but either way...he will get a judgment against you for unpaid rent, late fees, court costs & attorney fees.
He can then garnish your wages, levy your bank accounts, seized your IRS returns and place liens on any property your own now or in the future. This judgment will remain on your credit report for many years (up to 20years in most states)....making in nearly impossible to rent elsewhere. |

Talk to your leasing office. You don't want an eviction on your credit. It's tempting to just walk out without paying rent, but then you'll have a hard time getting someone to rent out to you in the future, or even if you want to start building credit to buy a house. |

From the 5 day notice to the actual eviction typically takes 30 to 45 days at LEAST. You'll be gone in time. Only a judge can issue an eviction order and it does take time. |

Look at your lease (if you have one). They will usually say that either party requires 30 days notice.
Also, in a lot of places, the landlord is not allowed to physically move you out. They need to serve notice to a court, and then have a Sherriff to do that. |

Yes they will kick you out. You may come home to a Sheriffs notice one day indicating that the locks have been changed and your stuff is in storage. And then you will have to pay to get your stuff out of storage.

They can't. They have to take you to court to kick you out and that takes months. If you live where it's cold, even if you don't pay your rent at all they can't kick you out during the winter. |

pink lady, I'm an apartment "super" and you're supposed to pay rent by the 5th of each month. I don't know the particulars, but depending on when pay it, that could make a difference. For your sake, I hope the landlord's lenient but sounds like a jerk to me. Good luck and have a nice move. Btw, by law I think they can kick you out. |

most likely, of course this is up to the particular landlord, most people dont like renting a place to people who can't afford to pay them, and the longer you are in his/her property, the more money he/she is losing |
