How long can a former tenant of an apartment leave something after being evicted?
My grandparents recently evicted a pair of less-than-savory men who left, by my estimation, almost $2000 worth of electronics including an Xbox 360, controllers, PS2, Sega Genesis, 2 TVs, and a Sony VAIO, among other things. How long are they forced to leave them for the former tenants to pick up? Is there a limit?

My friend owns the apartment building in which I live. The one tenant died last year, and his family was told that they had 2 months to remove everything from his apartment. They were told this verbally twice, and stated that they understood.
About a month in, his cousins came and took a few things out, but left the apartment pretty much a disaster area.
So, the DAY AFTER the two months was up, I started moving everything from the apartment out to the garage (because I wanted to move into the apartment). I donated everything that was small to the Salvation Army, and I had 2 garage sales and sold everything else.
About 8 months later, the former tenant's family called and said that they were "thinking" about coming back for his stuff. 8 MONTHS LATER ... AS IF WE WOULD HAVE LEFT THE STUFF IN THE APARTMENT FOR 8 MONTHS!!!!!!
They were told, yes, we kept his personal effects, pictures, diplomas, etc, but everything else is gone. They were given 2 months to get the stuff out. After that, the apartment was mine to do whatever with.

I suppose it depends on where in the world you live, but here they have to hold them for 90 days I beleive..in storage, not the home and then after that they can keep or sell them. I think you should be able to keep or sell them right away, but you can't. Google where you live for regulations governing this sort of thing.

This is a very localized question. Rental laws vary greatly by locality.

The first thing to make sure of is that there is a legal eviction. This means that you went to court and have a legal judgment granting eviction. If not, then the people aren't evicted.

If you have the legal eviction then you need to check your local laws regarding this. In some areas when a person is evicted they have to get all the stuff they want out right then and there. Some areas require you to keep items for 30 days, some 60, others 90. Some areas require you to keep the items in the apartment. Some areas allow you to move the items to storage. Some areas allow you to charge for the storage costs, some do not.

As you can see, this is something that varies greatly by where the apartment is located.

I would call the police and have them check the stuff against the stolen property reports, then sell it or use it myself.

It depends on state and local regulations. Check with a lawyer to find out what the statues are in the jurisidiction that the eviction occurred.

I WOULD THINK ONCE THEY ARE GONE, AND HAVE LEFT THEIR KEYS, YOU CAN KEEP ANYTHING, ESPECIALLY IF THEY OWE YOUR GRANDPARENTS $. You could sell the stuff on ebay or craigslist.com.

I live in NB Canada and when a person is being evicted they have to have their property out on the day of eviction. EX- Your grandparents give them notice that they are to be out by Sept 1/2008 their stuff needs to be gone on Sept 1/2008. I did just look online and for month to month rentals the landlord is required to give then tenant ONE MONTHS notice and after that month they are to be out completly, items and all.

I say give it 2 weeks thats a reasonable amount of time.

After the eviction is passed in court, they have NO time at all and it is all yours (g-parents) legally.. If they have only been served, they aren't legally evicted yet...you can't touch the stuff until it's gone to court. They could come to you after having being evicted that day and you could still keep it...legally!! I've seen landlords throw things from 2nd story windows (electronics etc) right in front of the evicted tenants...just to piss them off...and there is no legal action they can take against said landlord. After eviction, they have no rights. By the way...this is NY...where are you???
