KC | How long do I have once I receive a final eviction notice? |
I live in Montgomery County, MD & I recently received a final eviction notice. The notice says I have to get out immediately but does not give any specific time frame. Someone who works at Social Services told me, when you receive your final eviction notice, it's implied you have to get out now but he said for as long as he has worked at S.S., he's never seen anyone actually be evicted in less than a month. He said this is because the system is so backed up. I'm afraid to rely on this however, but at this moment, I have nowhere to go. I'm still in the process of trying to find somewhere. If anyone's been through this or knows of someone who has, and lives in Maryland, how long ago did this happen to you and how long did you actually have? Also, do you know if there would be a chance they would give me a little longer if I call and explain the situation, and should I call? This is not a landlord/tennant eviction. It's due to a forecloser on my home. Additional Details Please don't be harsh or judgmental here. You do not know what happened to me. Someone, not me, caused me to lose everything I've worked my whole life for & this is devistating enough without people being judgmental. Even though it says "final" notice,this is the ONLY eviction notice I've received & although it appears I've had plenty of time, you don't know the whole story & I haven't had as much time as it appears. |

A "final" eviction notice implies that there has already been at least one prior eviction notice. You need to move out immediately. |

It sounds like a 30 day notice before they take you to court.
There is no possible way for you to win at court, only further your problems by adding the eviction to your records.
So, you have 30 days witha clean record and not owing for the court costs, or 60 with an eviction on your record and a bill for their attorney. |

I don't know what the eviction process is for your state, but in most states I'm familiar with only a court can order an eviction and the sheriff must be present during the eviction. Call your local small claims court and ask them what the eviction process is for area if the eviction notice you received could be legitimate.
If the notice is legitimate, then you need to vacate immediately. Otherwise, the sheriff will physically remove you and your property from the unit. |

If the notice is official and your case had been decided by a judge, you have until the sheriff comes and forcibly removes you and your belongings.
It could be days or weeks depending onthe sheriff's schedule. You will not be given notice as to a date or time because you should have already vacated. |

Hmmm, with a foreclosure and the way the nation is right now, I don't see them being that harsh on you. In a typical situation it's up to the landlord, once they have it filed in the court system, the go pay an additional $80 to have the Sheriff go out there in a certain time frame to ensure that the person is moving.
This was in Florida, and a friend of mine had to evict someone, it seems like it depends on how much the "person" evicting you is willing to put out to make sure that it gets done. |

You get 30 days. You can try to call, but if this is a "final" eviction notice, that means they've given you others prior to this. No point in really trying to call. They don't care, they just want their money.
