first month, great pays on time. 2nd month, late, hands me his payroll check(i accepted due to his problems) and cant pay the utilities.. this month, paycheck is torn to pieces(i didnt accept), no utilities, quits his job, and his repo man is looking for. Are you ready for the kicker. his mom lives next to him as a neigbhor(she suggested, what nice (38 years old) son i have. i feel like i am in deep s===.

Kiss your rent good-bye. I imagine once his utilities are turned off, he will have to leave. It will be too much trouble to take him to court over what he owes you. File for eviction now. |

I've been there before. It isn't personal, just business. Time to have this guy move on. Even if it takes force. Try to explain it to him first. If that doesn't work than you have to use legal means. But your going to be taking it in the shorts if you can't get him to start paying or move out.
You can only be nice for so long, and I think you have been. |

If this guy is indeed 38 years old, then I would have a serious "sit-down" with him and discuss his future living in your building, unless your in the habit of taking in disaster cases. I think he is one.
Talk to him first, if you don't see a spark then, tell him you'll give him thirty days to straighten out his act and, give him written notice to that effect.
If he tries to pull anything like, moving in with his mother, also your building, then raise her rent to compensate for him, completely legal. |

never mind his mom is next door. you are in the money making market. you have rented a home to him on good faith and he must be liable to pay his bills.
give him writen notice that he has 30 days to move or pay his bills or he will be evicted...(do not see or speek to him again till you go to court.) while you are waiting out the 30 days get the paper work ready for his eviction. send them to the court house and await a court date...go to court.
get the judgement. it should go in your favor. make sure you have fixed all that needed to be fixed in the rental or that may go against you. have reciepts on hand in court to proove you took care of all that needed fixed(if anything) renters always use the "everything is broken excuse" to get around the judge and make you as a landlord look bad.
when you have gotten the judgment in your favor go to the property take everything out of the home and leave it on the curb for the trash pick up and change the locks on all the doors and fix the windows so they cant open them.
if hes there at the time get a police man to go there with you as you have a judgment to make the man leave the property and have given him ample time to leave the property and you would like some back up in case there is a problem.
if his mom comes out ask her to please go back home it doesnt concern her.

He will be a deadbeat as long as he can get away with it! start eviction proceedings and hope he doesn't destroy your property before they force him out in a mont or two!

Doesn't matter how long he'll be a deadbeat, you need to act to protect your own interests. Start eviction proceedings immediately, beginning with a 3-day Notice to Pay or Quit. The Court Clerk's office at the local courthouse can advise or any attorney can handle it for a few hundred $$$.
So, get on your bike and get moving! |
