How long does it take to get lies straightened out?
So I bought property thinking it had 2 1/2 acres and the house built in 1964. Only to find out day after closing that there is 1/2 acrea missing and house was built in 57. I go to my agent for help to be told afew days later I needed to get an attorney. I call the closing company for my survey and they said it would take several weeks. I call survey company myself and get it in afew days. It does not match the appraisal nor the information on the flyer that was given to me as to what the property consisted of. Now I have been waiting 1 year for someone to straighten this out. My mortgage is based on a lie when does this stuff get fixed and yeah I screwed up trusting 1 agent to sell me a home, sell my home and sell the home of the woman who bought my house. Everyone made money and I'm left holding a note for something I don't own. Does the buyer ever win in these kinds of things??

The financial institution does not want you to have a loan based on false info... should you default on the loan they are going to get screwed. But I still don't understand why they didn't send out their own appraiser. It is VERY rare that a financial institution will give out a loan without their own appraisal. The end result should be that the broker will permanently lose his license, and you very well may have a claim to reverse the whole deal.

This can end one of three ways. 1) You get tired of the legal red tape and give up chase. 2) You and your financial institution go after the broker and seller and rectify your situation. 3) After a long legal battle you reverse the sale, get all of your money back plus interest and return title of the property to the original owner.

The important things to remember are these:

You are in the right and will win this case in a court of law.

Your financial institution is on your side. They should be able to give you good advise, and I would be surprised if they wouldn't help in your legal case. Ofcourse, they are the ones who didn't demand an independent appraisal.

The best advise I can offer is to talk to your financial institution, and contact an attorney immediately. I would not expect results for at least another 6 months to a year. Good luck.

The house being built in '57 vs '64 doesn't matter.

What does matter is that your land is 1/2 acre short. Didn't the lawyer who handled your closing demand the prior survey or read the legal description of the property? Why did they allow you to close without a current survey?

You need a good real estate attorney to advise you.

Problems like this don't get straightened out unless you run after all the parties involved including your own attorneys. you have to make their lives so miserable that it is easier to ole your problem than deal with you.

Unfortunately once the money has changed hands they are not so helpful.

Where do you live? Most transactions require an appraisel and a title report. If you did this without them and you trusted an agent that had a commission coming from the sell you screwed up. It is your fault you never trust anyone. There is nothing that can be done if the contract you signed does not have a description of the property. Contact the state real estate dept and raise hell.

I don't know your state laws where you are, but it seems you probably have an excellent case against this agent and his or her insurance company, not to mention the broker bond and his or her license. Contact an attorney immediately. It does take a while, but there is no real alternative.
