How long to foreclosure?
I went through a divorce and recently lost my job. I called the mortgage company to let hem know. Is this something they will work with me on? I can't make the full payment, but can pay about 25 to 35% of the payment.

Its good to hear that you called the mortgage company BEFORE you started to really miss payments. Apparently most people do not do that.

Perhaps you could talk to a third party that can negotiate for you, for a fee of course, but if it lowers what you owe overall it would be worth it.

this month you can pay 25%. what about next month if you have no job? you'll just fall farther and farther behind. since you have no way to salvage your equity, just sit tight while they foreclose and evict you. no, they will probably not work with you. your focus should stay on where you'll live next and how you'll pay for it.

Depending on your lender, it's possible that even if you could only afford 25% NOW..they might not accept it and force you to pay the regular mortgage payment in full.

I would suggest you call your lender back and them about what the process would be for accepting a 'short-sale'.

A short-sale is nothing more then a bank accepting less on a piece of property then what is currently owed on it...and contrary to popular belief, one does NOT need to be behind on payments for a bank to accept an offer on a short-sale.

If your lender is not going to help you given your current financial situation, then I would suggest you sit down and ask yourself what's more important...keeping the house, risking at a later date/time falling behind on your mortgage, and possibly being 'foreclosed on', thus having what is deemed the worst hit to your credit report possible, or getting out from under an asset you can't afford to keep any more before it's too late?

Whatever the decision, make it as soon as possible and know your options.

I prefer to email if that is an option, I believe your situation is personal. Here are you real options
- Foreclose on the home (save every dollar you have ride it out and know that you it will be about 5 years before anyone will even consider giving you another loan, and your credit will have to be near perfect since then.)
- Do a re-fi on your current mortgage. (this is most likely out of reach because most homes do not have the equity, but it is an option.)
- Short Sell,
- Loan Modification. (A team of attorneys re-negotiate your current loan with your bank explaining why you have defaulted. YOU KEEP THE HOUSE. Then one of 4 or all 4 things happen. - Get out of an adjustable rate in to a fixed, lower rate on your current mortgage, extend your term, reduce your principle.) This is what me and my team do each and every day, we have a 98% success rate, and the 2% are the ones in process. It’s really simple, we keep people in their homes. I am currently in a situation where my business has gone from recession to depression. Just had to contact my mortgage holder the other day to let them know I'm having trouble as well making the payments. After speaking with a loan officer they have agreed to a refiance to lower my payments. Try speaking to your loan officer about a refiance. Any chance of taking on a roommate to help with the mortgage?

Well, you could just stop paying since it sounds like you won't be able to keep the house. Assuming your credit is already shot from the divorce, you could stop paying, let the foreclosure happen, and save what you would otherwise be paying towards moving expenses. Once the sale is complete, ask the lender for a "cash-for-keys" incentive to voluntarily vacate. Take the saved money and cash from the lender and get a more affordable. Depending on the jurisdiction, you could live rent-free for a considerable amount of time. It's a shady path to tread, but legal.
