Laws differ from state to state. When you're in yahoo use the phrase tenant and landlord right in (whatever state you're in) in the search engine. I just tried it and all kinds of info came up.

Hopefully you do not reside in Illinois, sometimes it takes six months to evict a tenant.

As a landlord, you should be familiar with your state's landlord-tenant laws.

Depends. So don't delay, give tenant the required notice immediately and file suit to evict them. Be SURE to ask for court costs and attorneys fees, plus all rent due in case. Notice varies in different states, 3,5,7,10 day notices. Must deliver notice to tenant NOT just post it on doors. They have to be served by sheriff within 20 days of filing suit, if they don't find them, try again, 20-30 days to answer, possible continuance, order of possession. . . .delays in eviction in cold weather, so hurry up and act.

30 days is the standard notice for evicting a resident, but you should have a clause in your contract about the specific amount of time they have to move out if they do not pay.

That DEPENDS on the State. But if You consider yourself a GOOD Landlord (considering the Times), you'll WAIT til the end of the Month (if he or she still hasn't paid), to give them their 30 Day "Notice." -Just make SURE their "lateness" isn't due to some kind of "Mishap, or Misunderstanding..." Checks actually DO "get lost in the Mail"- sometimes! :)

You need to get an order to have them removed. If you remove em' now, I'll be watching you on Judge Judy :P Also, several deals come into play: Do they have children? Are they trying to work it out with you? 1 month is too soon.

i think its 3 days but dont be an ***, let them know they have 30 days to pay or leave. Document it on the day you give the ultimatum so if you have to, get the police to kick them out if they dont leave.

There are different tenant rules for different states. What happens in my state is that you have to give your tenant a 30 day notice to quit, in writing that's the first step. Then if they still do not pay or you want them out, you need to follow your lease agreement, although, there may be problems with the colder weather approaching us. Also, if the tenant has children or is or has an elderly person living with them or a handicapped person living with them. There can be many issues to deal with as well as what you are evicting the tenant for, and what you have or haven't done as a landlord to provide rental lease agreements. Or if you haven't done your part as a landlord.

Start making phone calls to your state's government offices. It varies from state to state. I know Oregon can be as long as 90 days if they're stubborn.

If I were you, I would start the process as soon as possible to have a sheriff escort them off the premises.

And as soon as they're gone change the locks.

Also, try to be sensitive to their feelings because it can be a hard emotional experience. I would talk to them and have them look at it from your point of view, tell them, if you were renting a place to me, you wouldn't want to loose monthly money would you? try to have them see it from your perspective
