How many days should I give my tentant who is late paying?
I am new at rental management. My tentant siged a 1 year lease beginning June 1st. He paid both on time with a postal money order. He has not paid July rent. He sent me an email and apologized that he had a "financial emergency" and would pay as soon as possible (no exact date, though.) I didn't do a credit check (stupid, I know) and I don't have a good feeling. How long should I wait before I filing the eviction paperwork?

Ask for more info on his "situation" and an estimated time frame for his payment. explain to him that you have bills to pay too. If you feel he is an honest person, you may even wnat to set up a payment plan with him in an effort to help out both you and him. Get it all in writing if you do. Otherwise, I would only give him 2 weeks to make an arrangement with you on his own. You don't want this to start dragging on into other months payments.

You should have the answer to that in your contract or contact an attorney and ask what the legal time limit is

Today is the 7th and I usally give a grace period of 5 days and if he or she doesn't pay with in the 5 days I then tax on a late charge and give them til the 15th If the rent is not payed by then I send them down. Good luck and next time do a credit check and background.

What does your lease say? Duh! You're the landlord, you should know what agreement you have with your tenants! How could you have not run a credit check? Big mistake. Take it as a lesson learned. Good luck with this bum, I have a feeling you won't be getting paid.

30 days is usually the norm before advising the renter that unless the late rent as well as the next month's rent is paid by the due date that he will be given a notice of eviction....depending on what state you are in.

financial emergencies do happen and he did let you know by e-mail that he was going to be late.

Stay in contact with your renter, this is only the 7th of july, and he may surprise you and pay you by his next payday

Give the guy a chance. Unexpected financial things do happen. Try to call him and see when he can make the rent payment. If it's a repeat thing, then there's a reason to evict. I'm a renter and I've fallen behind on rent a few times and communication between landlord and tenant is important. Good luck!

the longer you wait the longer it will take to evict him. start the eviction process today go down to court and file, at least if he pays you have sent him a message that you do not play games, if he doesn't pay then the process has started and you can get him out soon

give him/her 10 days, then make it a point to say somethign again. Then tell them they have 5 days before you file the paper work. But be careful this may become a repeated thing. Don't want that.. If at all possible have a contract written up stating late pay if they dont pay on-time agian.

Normally rent should be due on the first late after the fifth. On the sixth you need to add late charges (usually $15). That same day send out late notices. The following week send out another late notice but on this one let them know that eviction will be filed. For example, on the 12th I will be giving out eviction notices and they will say that on the 17th eviciton will be filed.

Call him and ask him for an exact date if he doesnt give you an acceptable answer then ask him when his next pay check is coming and when he tells you make THAT the date.... if he doesnt pay then start the proceedings

every state is different , one time my apartment lost my check , rent was due on the 1st , on the 6th they put an evection notice on my door giving me 3 days .

I would consult a lawyer to find out what the laws in your area prescribe.

In the future, I would include whatever you find out from your lawyer about the time period to wait in any lease you have the renter sign.

Does your rental contract specify rent payment dates, and late fees and such? If not, that was a mistake you should learn from. Get EVERYTHING spelled out up front.

Send the tenant a letter stating when the rent is due and what the penalty for late payment is right now.

Begin eviction procedures immediately after terms are broken.

If you don't, you will wind up with a freeloading tenant.

You should post a notice on his door ASAP telling him he has 30 days to pay or be evicted.

Typically, if the person has not paid by the 3rd, you can do this, but if your lease agreement has a specified date, you must abide by that. If not, you can technically do it on the day after the rent is due.

Next time you need to make sure that this is all stated in the lease. "All payments must be received by 5pm on the 1st of every month. Any late payments will be subjected to a $25 per day fee. A late payment by more than 5 days will result in the filing of eviction papers." Call up this tenant and say you need a date. If they can't give you one, tell them that you are going to have to evict them.

Check your local renters laws. Nonpayment of rent usually will allow you to write an eviction notice with 10 days notice. If he pays within the ten days, the eviction is void and he continues to live there. If he does NOT pay, then you can have him foribly removed from the premises, with the help of the police. The fact that he signed a one year lease means he will still be liable for rent payments for the rest of the one year.

Thats the way i understand tenancy laws in Canada. your local laws may be slightly different, plus check the lease. see if there are any details to do with non payment or eviction.
