if he really got robbed he owes you nothing, if he's just saying he got robbed he owes you $400 plus

In court it would be neither. The law states that you would get the current value of the phone. If it's a brand new phone, he would owe you $200.00. If you have had the phone for a while, it would be less than $200.00 due to depreciation. Either way, he did not actually get the $400.00 for the phone, so he would owe $200.00 or less.

It depends upon the terms of the agreement your friend offered you, regarding the money he was going to give you before he got robbed.

If he was going to pay you $200, then that's what he owes you. If you were going to get the entire $400 after the completion of the sale, then that is what the agreement dictates he owes you.

Basically, if he took the phone in agreement to give you $400, then he is still liable for that whole amount even though theft occurred during his possession of the product.

A reminder: verbal agreements stand up in court, you just have to prove them.
