How much notice do I have to give the landlord before I move out?? (I never had a lease).?
I moved into the place Im at in May of this year....I cant stand the neighborhood Im in, nor the people in this building, so my husband and I found this beautiful apartment in a nice neighborhood so we are moving. I already put down the security at the new place. I wanted to know how much notice I have to give my current landlord that we are moving? I never had to sign a lease. State laws require that you give 30 days notice (15 in Florida) at the beginning of your monthly lease term.

Yes..you do have a lease. State law creates one for you in absence of a written lease. It's called a "tenant at will" or "month to month tenant".

So in order to move out on August 1st, you would have needed to give WRITTEN notice on or before July 1st. Legally, if you give notice now...you will still be responsible for the full month of August.
(California is different...If you give notice in Calif now...you would be responsible for rent until August 12).

30 days even if you do not have a lease, do it in writing if you have a security deposit given to the landlord, take pictures so it will proof what condition you had left the place.

One month should be sufficient. If you do not have a lease you will not be in trouble if you leave before next months rent is due. It would be polite to give your landlord a 30 day notice, so he can begin searching for a new tenant.

yea i think at least 30 days should be sufficient. even if you dont have a lease, its only courteous. Just think about how much notice you would want if you landlord wanted you to move out

Most Tenancies are required to give at least thirty day notice. I'm sure that applies even to verbal agreements... They may try and keep your deposit in lieu of the two weeks you're trying to "skip out on" ....

If you pay rent once a month, and did not sign a lease or any type of rental agreement, I would say you have a month-to-month verbal rental agreement. Although you will want to confirm this, unless you and the landlord agreed to some other length of time, I believe you need to give your landlord one month advance notice that you will vacate your apartment. If you will be leaving 7/31/08 (8/1/08 likely starts the new monthly rental period, so you might have to be out on 7/31/08), you should have told your landlord on 7/1/08 that you would no longer renting as of 8/1/08.

Since your landlord did not have you sign a formal lease, that could indicate that he/she would be willing to let you give them a shorter notice and might also let you stay until 8/1/08. When you talk to the landlord, bring a friend as a witness to any verbal agreement you and the landlord make regarding your departure. Getting the agreement in writing would be better, if you are so inclined to ask.

if there is no lease then you can give them as little notice as you want...but common courtesy because they have to find someone to replace don't expect your deposit back. Give them in writing reason for your move and the date you plan on being completely out.
