I have been in the property more than 6 months...(as per tenancy agreement minimum term)
its is in england. Additional Details I had heard anecdotally that legally you may only be required to give 1 months notice. I am paying monthly, and have been in the property over a year. The landlord is trying to sell the property, and although we have not been given official notice to terminate the contract by the landlord, who wants us to stay on until the property is sold... we have been accomodating (and we are exceeding what is legally required of us) by allowing viewings at short notice (which we only have to do this from 4 weeks before the end of the tenancy apparently). I should say that we do want to stay with the letting agents, and that the difficulty arises in finding a new place to rent with a landlord who is prepared to wait for 2 months for us to move in. Financially we are not in a position to pay rent on 2 places simultaniously, neither can we afford to pay for new references etc with another estate agent. Our lettings agency has only deals with a small number of properties a year.. |

It actually depends on the duration of the rent and tenant's agreement with a landlord in contract.
Over the last three years i've rented couple flats but the notices were set to give 1 month before you leave, the reason why landlord needs extra time is to place the property in the market and get someone into the flat without losing any days.
In my opinion 1 month is quite ENOUGH to get someone into flat, in your case most likely property doesn't complies with proper standards so landlord experience difficulties to rent the flat quickly, so maybe that's why 2 months notice been asked to give.
If you find someone else to the flat there is no need for any notices.

The contract you signed is legally binding. Why don't you just ask the landlord if you could give a months notice and then move out, just ask him if he says no then give a 2 months notice. Alot of landlords like to work with their tenents, It doesn't hurt to ask. |

Hi mate,
well as most of agencies do - they all write that the min. notice is due to 2 months beforehand expiring of the tenancy agreement. But i've moved quite alot around London, and i know from personal experience that one month or max three weeks is enough for them to sort out the documentation. Because they have to speak with the landlord....

Legally you are obliged to give 2 months notice as per contract but have you actually spoken to your landlord. As you have been amenable to him you will probably find he will be more than ok about you moving out early. Vacant posses ion of a house is a great selling feature so it is in his interest if you move out early. |

The agreement is 2 months but the law is vague on this!
If you pay monthly - you may only have to give 1 months notice - there have been cases similar to this and the judgements have been different in the cases - split 50 - 50
Not much help I'm afraid but on this one - sometimes you have to bite the bullet so to speak - play safe and get it checked out properly - |
