How much notice does a tenant have to leave?
From what I understand, I think a landlord has to give 60 days notice for a tenant to move out. I am in California.

How much notice does a tenant have to leave, 30 days or also 60 days? The rental agreement says 30 days either side, but from what I know, which isn't much, I have heard it has to be 60 days notice if the tenant has lived there over a year. Does anyone know if it's the same the other way around with the tenant having to leave 60 days notice also?

Well, the best advice is what does your lease agreement state. I have lived in a couple states and it has changed from landlord to landlord..
Most recently it was after one year, all I needed was a 30 day notice. If I had to move out before the year agreement was over then it was 60 day notice, and I had to pay for advertising, and rent for any months that the apartment is vacant up to the end of the original lease.

It should be on your contract. If the contract you signed says 30 days for tenant, then its 30 days.
Just read your whole contract carefully.

I would think if your rental agreement says 30 days, you could submit your 30 day notice together with a copy of the agreement highlighting the part that says 30 days. Make sure you certify mail the notice with " Return Receipt Requested". That way you will have written confirmation they received the notice.

It depends on the reason the landlord is asking you to leave and then what city you're in. Without rent control the landlord can set the lease agreement at any amount they choose. Without tenant rights a landlord can evict anyone for breach of the lease, but they have to go to court to do that. Places like the Bay area have been known to have 6 month long eviction proceedings for non-payment of rent. You also can't increase rent by more than inflation adjusted figures the city puts out.
Generally though it's whatever your lease says for breaking it. Though if you violate the agreement the landlord has to take you to court to get the money.

If you have a lease in hand, signed by all parties, you go by the lease, not the number of years or months.

Landlord's notice to end a periodic tenancy

A landlord can end a periodic tenancy(for example, a month-to-month tenancy) by giving the tenant proper advance written notice. Your landlord must give you 60 days' advance written notice that the tenancy will end if you and every other tenant or resident have lived in the rental unit for a year or more.181 However, the landlord can give you 30 days' advance written notice in either of the following situations:

Any tenant or resident has lived in the rental unit less than one year;182 or
The landlord has contracted to sell the rental unit to another person who intends to occupy it for at least a year after the tenancy ends. In addition, all of the following must be true in order for the selling landlord to give you a 30-day notice
The landlord must have opened escrow with a licensed escrow agent or real estate broker, and
The landlord must have given you the 30-day notice no later than 120 days after opening the escrow, and
The landlord must not previously have given you a 30-day or 60-day notice, and
The rental unit must be one that can be sold separately from any other dwelling unit.182a
The landlord usually isn't required to state a reason for ending the tenancy in the 30-day or 60-day notice (see "Thirty-Day or Sixty-Day Notice"). The landlord can serve the 30-day or 60-day notice by certified mail or by one of the methods described under "Proper Service of Notices".182b


Now if you are giving notice to move you only have to give 30 days notice if you rent month to month. One you have all your stuff out make sure you take plenty of pictures and document things. Your landlord has 21 days from the time you hand over your keys to get you your deposit back or a itemized list with receipts.

It depends on the reason they are being asked to move. If it is just because, then it is thirty days. If they are being evicted because of something they've done, then it can be anywhere from 3 days to 20.

It's whatever the lease dictates. If the lease states that you only need to provide 30 days notice then that's all you need to provide. Just because a law might state you should provide 60 you go by what is stated in your lease agreement with that rental company. You might be nice enough to provide 60 days but if your LL wants you out, he'll only give you 30.
