A M | How much of a notice do you need to give a landlord? |
My cousin is movinig from an apartment where she has had nothing but bad luck with the landlord (no fault of her own, this person is just difficult!). She now wants to move back to Ohio (she is currently in Vermont).They never gave her a lease so she paid from month to month. How much of a notice must she give a landlord if she did not have a lease to begin with?

Some one mentioned to double check about her having a lease. No, she definatleyu does not have one. The other question that I forgot to include is if she gives 30 days notice but is out before the rent is due for the following month, would she stil owe her landlord?She reallhy does not care about her deposit but she does not want to be stuck with 2 rents (one at her new place in Ohio and one at her current). Thanks for all of your help because I have no idea what to tell her! |

In the absence of a signed lease she is considered to be on a month to month lease. for this she must give the landlord 30 days notice that she is leaving. most states require that notice be given at the start of a rental term. that means that she can tell the landlord on Oct 1 that she is leaving on Oct 31. She cal always tell him earlier but she's stuck there until the 31st of October.

Well I found out today that in WI it is a law to give 28 days notice...good by security deposit. I would do a google search about Vermont tentant and landlord laws. |

she must have some paper signed by landlord, check, but any way you asr suppossed to give 30 days notice that you are moving out in writting, that is the way to do things |

If she's currently paying month to month, generally they'll expect a months' notice. If there's no lease, there shouldn't be a problem. Just have her be sure she's ready to move, as the landlord may want to show the apartment or even have someone ready to move in on day 31. |

Here is what the law says
(A) For tenants who have resided continuously in the same premises for two years or less, at least 60 days after the date of the actual notice.
(B) For tenants who have resided continuously in the same premises for more than two years, at least 90 days after the date of the actual notice.
