How often should landlord replace carpet?
We moved in six months ago..after a tenant who was here for 9yrs.We had to move in pretty fast because of our previous situation but the landlord had like 2 weeks in advance to get things in order.He didn't paint the place claiming his painter got injured, so he deducted 200 off the move in. But about a month later i bought paint and stuff and we painted the majority of the apt except the roof..the landlord hasnt bothered to offer his guy to come complete the job There are stains on the carpet everywhereand is kind of loose. Landlord had the nerve to shampoo it just hours b4 we moved in so it was still wet and its still filthy. I even think there may be mold underneath. We have a baby on the way and we are worried abot allergens and other stuff..how can we prove this carpet has been here for 9 years and get him to replace it?

I don't know the laws about these things. You can check with your local housing authority about landlord/tenant rights and see what the local laws say. Some places let landlords get away with everything and other places let tenants get away with everything. I think that in general though they are supposed to replace the carpets every 7-10 years. I had a friend that lived in housing while she was growing up and I remember that because of HUD rules that carpet had to be replaced every 7years and that time period came up while they were living there and their whole place was torn up while they were getting new carpet.
And if you can't get anything done about the carpet then I would move before your new little one starts crawling around and needing lots of floor time.

Slo- you need to write a letter to the management company, telling them just that. You should also take pictures and state that you are concerned about the age and condition of the problem and your wife, being pregnant is having trouble sleeping and is also having difficulty breathing.

If the landlord does not respond with a positive response, then write another letter and send a copy of the original letter with it.

You have rights to live in a clean sterile environment.

Unforetunately you have no choice in the matter. If it is written in you contract that he would have the place cleaned and replacement of carpet then you could do something about it but if there is nothing then you out of luck. It is "As is" when you rented it and I am sorry. The only thing you can do is to continue to complain to him. But if the carpet has a "wrinkle", where part of the carpet doesn't lay flat but it buckles, (because you said it was loose) then your landlord would be very wise to replace it because that is a hazard you can trip and if you injure yourself you can sue him.

you could start looking for another place, unless you can prove that the carpet is a health hazard. But do you want to live in a place with a pissed off landlord?

Under only one of two circumstances could you force him to change the carpet: 1) You can show that you had a written or verbal contract for the carpet to be changed upon your moving in. A verbal contract will be very hard to prove. Furthermore, if you signed some sort of "inspection sheet" upon move in that did not note the problems with the carpet, you will have an even harder time. 2) In some jurisdictions,if you can prove that the carpet is a health hazard, and that hazard is directly the result of the landlord, then you may be able to force him to correct it.

Beyond that, nothing compels a landlord to make any non necessary repairs to a house, where necessary refers to things like having electricity, water, possibly stove/refrigerator, etc.

track the old tenant or get the landlord to put it down in black and white stating its' age in case your child comes down sick in future from some sickness that could be caused by mold

The landlord doesn't have to replace the carpet but if he continues, move to another apartment and stop paying rent citing the fact that you were moving because of the living situation, if he takes you to small claims court, he'd most likely lose with you losing your rent deposit.

Oh dear, Im sorry for what you are dealing with! Two weeks is beyond plenty of time for them to get the job done, regardless of circumstances. If there is a lot of work needing to be done, they hire companies (Rather than just one or two workers) who will come in and get the job done stat. I just moved into my apartment and they had one month to prep. In one week, it was repainted (its 700 sq. ft though), brand new carpet installed, new microhood above stove, and new ceiling fans/washer/dryer..
Hopefully your landlord is understanding and you can explain that the carpet most def. needs to be replaced. If not, I would try to get out of that place as soon as possible. It may seem unfeasable to break a contract, but you have a right if he wont comply with properly cleaning the place before move-in.
Its not a healthy environment for your lady or baby..

Carpet life is usually 5-7 years. The best time to sort these things out is at the beginning of a lease. At least he could do a better job getting it cleaned and restreached.
