to make it legal the mortgage must be paid off and a new mortgage and deed prepared with both names.
You don't have "the deed" to give to someone else until the mortgage is paid in full. |

You can add anyone you want to the title of the property and you DON"T NEED to get the OK from your lender.
However, you are giving away ownership in the property and you still owe the money.
I can't see any reason to do this. |

Depends upon where you live. My parents are in Indiana. They didn't own their house until they paid off the mortgage. I sell real estate in Texas. I own my house and the lender has a lien against it. I can easily add anybody to the deed to my house, but as stated by some above me, that would not be advisable.
Talk to a local real estate attorney before doing this. Too often, people do things in real estate without knowing all the future ramifications - that's part of how we got into this "mortgage crisis" we're in...... |

You have to instruct a solicitor to do this for you - I work in this line of work. Its a transfer of equity and is quite straightforward. You have to inform your mortgage lender though. |

In the UK you own the property, the mortgage lender simply has a charge on it. As for adding a new name, you'll need to speak to your solicitor but it may not be possible without adding them also as a joint name on the mortgage. |

you have to go through a solicitor and 'gift' shared ownership - i did this with my new husband even though his name was already on the mortgage i had to sort out the title deeds in this way. |

You cannot. A solicitor has to do this for you, and you must inform whoever you have your mortgage with. They gave YOU the loan, not some person unknown to them. |

If you carry a mortgage, you don't yet own the property. So, you can't add anyone without them qualifying. You would essentially have to re-finance to re-write the loan docs and so the added person would have to qualify just like you would for the loan. There is no such thing as just adding someone to your title until you own the home and have the title. Then you can add who you wish. The only thing you can adjust before the home is paid for without re-financing is to take someone off of the loan. The main person responsible on the loan can quit claim the secondary to relieve that person of any resposibility and any future gain on that particular property. Anything that involves your lender taking a risk, the whole deal has to be re-written, which mean qualifying all over again, both the original borrower and the intended addition. If they don't have a good credit history, then why would you even add them to the title?
Keep in mind that once you add someone to the title, you....
1. Cannot have them removed without THEM agreeing to it.
2. You give away 50% of your property, including the profits.
3. You cannot sell it or refinance it without their signature.
4. If you are NOT legally married to an individual that is on title with you....this is a huge mistake...b/c the law treats that person as a business partner...and you don't have the same legal rights as married couples. |
