How to cancel a contract with a realtor after just signing .?

if she backed out in the time frame allowed then he can not hold her to the contract......hes bluffing.....

Also you can report him to some realtor board....not sure of the name.....Also.......was your mom alone with him when he had her sign the paper? If yes then.....all you need to do is get a lawyer and take him to court and tell the judge that he told her she could back out in so many days and now he changed it and their was no witness to this......just go after the creep

You need to contact the agent's broker. This will be the fastest and easiest way to get your mother out of the contract. Call the company and find out who the broker is. Tell the broker your mother is 83 years old and tell the broker the concerns you and your mother have and let the broker know your mother has been trying to get out of the contract with the agent. The broker is the one who has the ability to release your mother from the contract (in most states the agent doesn't even have the authority to release a client from a contract, only the broker). Good luck. I expect you will get results from the broker.

Contact the broker of his office.

Technically the contract is with the brokerage (in my area anyway) not the individual agent. The broker can choose to release her or assign another agent to represent her.

Contact the agent's broker about the contract. Explain that your mother has no faith in the agent. Ensure that he understands that you plan to take this matter to the local real estate board and failure to get satisfaction there you will take legal action against the agent, the broker as well as the local board.

You might also get your local city councilman/woman to take a look and see what they can do.

I would also write a letter to the Better Business Bureau about the incident.

Normally there is a period of time in which a person can legally get out of a contract. Three days seem like a normal period of waiting.

Tell him you will report him to the real estate commission, find out who works for and report him to his superiors and let them know the same info. Also let him know that you are going to the media and seeing if they want to do a story about a Realtor whose about to rip-off an 83 year old woman. If that doesn't work start putting ad's in the paper letting people know about this realtor and there co.

The contract is with the broker and it is not in the broker's interest to have a patently unhappy client.

While most of these answers are good, there is one item critical to the proper rescission of this contract. If the contract is in writing, the termination MUST ALSO be in writing.

Let's be clear: your mom has HIRED the agent and can terminate agent at any time. The only issue at that time will be whether the agent actually performed or did anything that might earn the commission.

Also, an agent would clearly be seen as unethical if he/she tried to enforce an agreement against an 83 year old woman in a court of law (where everything is matter of public record). Was there duress involved? Tell the agent you plan to contact the local newspaper and the local "troubleshooter" television news team to boot if you don't receive a signed letter with agent agreeing to cancel the contract immediately. You have 72 hours to cancel a contract in Ohio. I'm not sure about other states. You may have to surrender your down payment though. Which is why I never give them a lot of money for the "good faith" deposit. If the 72 hours is past, she cannot get out without an attorney. If that's the case get one quick. She may even want to get one to stop the contract if she has more hours of the 72 left, especially if the realtor doesn't want her to. She can also turn him in to the states board of realtors, and to the manager or owner of his firm. All realtors have to be licensed by the state and can be sued for malpractice and can lose their licenses for not adhereing to state and federal laws.

You cannot say that you were power of attorney unless you actually have a POA paper, signed and notarized prior to the contract. Don't bother with the multiple listing service either. They are simply there to publish homes for sale in a book for realtors to look at. Go to your state governments official website and look up the the real estate board and contact them. They will pull this man's license if he is trying to break the law, which is what it sounds like. He does not have any authority to force someone to adhere to a contract if it is within the 72 hour time frame. Like I said, after that time has passed you will need to take your mother to an attorney (which isn't going to be cheap). I wonder if he coerced her into signing the contract???? Another angle to look at.

Contact his supervisor at the realty office. If you don't get any satisfaction, contact your local multiple real estate listing service and explain your situation to them. They have highly informed people working there that can offer advice. Search the web for them in your area. For instance I live in Ohio. Ours is The Northern Ohio Multiple Listing Service. NORMLS for short. They are all affiliated with a national organization.

Tell them you have power of attorney that your mom is a bit old and suffering from dimentia, that she can not legally enter into a contract because she does NOt know what she is doing. Then politely explain that you could mutually agree to void the contract or waste everyones time and money going to court.
Also if she was buying and it enters into a court debate, in some states it automatically freezes the property from being sold until the outcome has been decided. Meaning that if you go thru litigation they can not sell it to someone else and court could take years.Most realtors are counting on you not knowing that.in the mean time noone gets any money and the owner is stuck with it unless they want to release youfrom the contract.
I would go the route of talking to someone above the realtor and play it up that your mom is not competent and you apologize for everything.
