How to cancel an apartment lease, with a friend?
My friend and I applied for an apartment in April and got approved. We are due to move into the apartment in June. However, I kind of hit a wall financially and will not be able to go forward with the plan.

I talked to her about telling her that we will have to cancel it and if she could give me a couple months (after the summer) to become financially competent. Of course she was upset and kept saying that it was a contract but we haven't moved in yet. WE only payed the application fee ( no rent fee). What is the best way to break it to her again but stand my ground? I try to tell her to be realistic that I don't want to live pay check to pay check and struggling however, I don't want our friendship dampened either.

She likes things her way and will not budge yet she can't force me into doing anything either. I know when shopping for a lease you have an obligation to go through but if I ended up where I was no longer able to afford the apartment can I walk away (legally and appropriately of course)?

You signed a legal document! You indicate that if you go through with this rental situation you would be living paycheck to paycheck and strugling. So, it's good for you, will build character, teach you to stand on your own two feet and learn how to use your inginuity. There's nothing wrong with a little strugling when you're young...or when you are older for that matter. What doesn't kill us, makes us stronger. Follow through on your obligation and commitment. If you try to walk away you could be in for a big shock and a huge bill for breaking a legal contract.

It doesn't matter what your friend decides, the landlord will still hold both of you to the terms of the lease.

You are obligated to the lease you signed. Losing income is NOT a valid reason to break your agreement. Should you fail to pay as agreed, you can be sued by both the landlord and your friend.

Today is June 1st and you are trying to bail on your friend and landlord just before your move in date?!

Some Friend you are.

Your friend is right. It is a legally binding contract. You can't break it without some serious consequences.

Your friend can force you to live up to your contract and so can the landlord.

You cannot legally or appropriately walk away from the lease.

Actually, you sound like the one that likes things her way ... regardless of what others are left with ...
