How to deal with tenant doesn't pay rent?
I have a tenant who rejected to pay the rent for this month. I have already followed BC tenancy act to give him a 10 day notice. According to the residency act, he has to move out within 10 days if he doesn't pay rent. However, leagally I cannot kick him out until sheriff come to get him out, which the process might take about 2 months to get the sheriff.

I am quite sure he intended to do this and I believe he was kicked out by previous landlord for the same reason. Stay in the apartment by paying the first month rent and no payment for the next couple months, by this he can stay until the court make enforcement to him.

Now I want to get ideas how I can kick him out asap? My apartment is fully furnished. Can I give him 24 hour notice and then access my property to move out my furniture? Any suggestion that is legal but can force him to move out?

give him a 30 day notice to leave or pay. make copies and put the dates on there, if he doesn't leave in 30 days then notify the cops that you gave him the notice and his time is up. you will have proof and he will be gone. if they don't do anything after the 30 days, wait till he leaves then change the locks and pack up his sh*t and kick him out.

Follow through with your rights, through legal actions. LLs should be fair, but it doesn't pay to be nice, to give extra time, to wait, because then it further delays when you get them out.

Next time, vet your tenants in advance, carefully. ALWAYS call the prior landlords to find out about the tenants' payment history, upkeep, problems, etc. Verify employment. Get an application with pertinent information so you can find them, sue them, etc.

Landlords must obey the law for their state or province, plus any local or city regulations. If you do not follow the law EXACTLY, you are the one who gets sued and gets into assorted trouble. You have read the tenancy act carefully -- follow it. If you have any questions on procedure, be sure to consult an attorney who specializes in Landlord-Tenant AND represents Landlords (not a tenant's attorney!).

The solution for your next tenant is to follow the usual procedures landlords use to protect themselves. Have applicants fill out an application form with credit references and employment references. Check them! Access credit reports -- look for a landlord's association in your area since they often have a deal for members on discounted credit reports or a "landlord's blacklist" of tenants who have had to be evicted for non-payment, drug trafficking and assorted criminal behavior. Require first, last and one month security (or first and two months' security), unless local laws prohibit that.

Check references, check references -- it cannot be said too often! That is your primary defense against chronic deadbeats and troublemakers. It cannot prevent all ills -- people with good credit & good jobs still get axed in a bad economy or become seriously ill. You cannot protect yourself against every eventuality, but you can prevent most.

On the 11th day after the eviction notice, your tenant doesn't have a legitimate legal claim to occupancy and can be forced to leave at any time.
As your tenant is creative and misuses the intent of the law, you should do the same. On the 11th day, cut any utilities to the apartment that you can. being a nice person, you go to the tenant's to advise him of the cessation of the utilities. He threatens you or causes a disturbance and you call the police. They respond and your complaint includes the fact that he's there illegally. They kick him out.

no, you can't take the furniture...you rented it furnished. There is really nothing you can do legally aside from waiting for the sheriff. You should ask him why he is not paying rent?? did he give you a reason?? does he just not have the money? you could make him want to leave...keep bugging him, call him at night and ask if he has the money yet. otherwise wait for the sheriff and then sue him for what he owes you. That is the pain you get when you rent!! the law is with the tennants -not the landlord!

Better screening might have saved you this headache...I'm sorry to hear this, but it is definitely part of being a landlord.

In my state, there is a 5 day pay or quit, which seems similar to the 10 day notice you provided. I am guessing the furnishings are part of the rental, so you likely can't act on those until you act on the property itself...which sounds like it will be 10 days from now.

I am sorry this is happening to you...I have been there!
