I have a tenant who has been recieving housing benefits and JSA totalling £900+ per month but hasnt been giving me my rent money regularly. the rent is £715 whilst her housing benfits is £710. I know for a FACT she is getting it as ppl at the council have told me, but she claims theyre lying. she is currently in £2000 debt and her 6month tenancy agreement is coming to an end soon so i will not be remnewing it and will ask her to leave. But, how do i recover the rent money, which I know she has been getting?? Seems like all the laws now protect her, and I can't even keep asking for the money as it will be made out to be landlord ''harrasment''.
On top of this the ***** is working so i know she can afford it. i did drop her in it with the benefit fraud people though, so hope to see her in jail soon!

The only thing you can really do is to make a claim against her in the small claims court, and hope they order her to pay a decent amount each month. If she's claiming poverty though, you may only get a very low monthly payment, but then some money is better than nothing!
Have a look on my site below, which has a guide to using Money Claim Online, which is run by the UK Court service and allows you to file your claim online. The guide is aimed at bank charges, but it shows each page of the site and what you need to enter, so you can just adapt the info for your claim. |

Ask the Housing Benefit people why the money wasn't paid directly to you, it should have been?.
The best thing you can do is kick her out and then screw her credit file with a CCJ. Make it difficult for the ********* to find another property.
She sounds like the type who will do damage. Perhaps a foreign holiday for you whilst a few heavies drop in on her for a little chat......
I had a similar problem, again a female tenant. I went away, she had an unfortunate accident. A few weeks later I was paid. |

That's why most landlords won't rent to DSS! There's nothing to say that you will ever see that money.
Begin eviction procedures, but make sure that you yourself stay on the right side of the law so that she's got no comeback and you can't be done for harrassment. It's unlikely that you'll get your money though.
Next time only rent to those who are in full-time employment. |

I presume that you're holding her deposit money, which should cover at least 6 weeks rental? That can be offset against what she owes you.
You might have to chalk it up to experience, and get good references from the people you rent to next. |

report her to the social and they should be paying u the rent money into your account they shouldnt be paying it to her! |

Issue a notice seeking possession now on the ground...(8??) Rent arrears
This will get her into court and you can sort out the money from there
Also contact the housing benefit department because if she is more than 8 weeks in arrears they have to pay you the benefit not her |

talking from experience once you start having problems like these give notice and cut your losses...90% of tenants are good..find a better on and move on...what goes around comes around there is no reasoning with this time of person if she is prepared to commit fraud and con the council...you have no chance of sorting her out or getting your money...just talking from experience... |

ask the council to send cheques direct to you and CCJ her for the rest. i rented off a friend and never got receipts. when we fell out cos i moved out and got married she took out a CCJ against me. the judge said he believed me but because i had no evidence he had to judge in her favour. then htye can take money off her benefit or out wages |

sell her to the polish as a sex slave u should be able to get around 4k if she is in a good condition.
seriously why did u shop her in while she was still renting from you?
she has obviously figured that it was you and is making life difficult.
good luck with getting her out at the end of the tenancy it cost me 5k to do that not mentioning the cost of redoing up the property after it was vacated |
