So three years ago my husband put a house in his name for his sister and her family. Unfortunately, he couldn't say no as his mom pressured him and his sister has kids. Well, three years later we want to buy a house, but due to debt-to-income he can't get a loan. His mom did his taxes for years and never put the house on his taxes (it's as if he lives there. doesn't claim the interest or anything like that) as he would've owed. His sister can't get the house in her husbands name because he had a car repo'd years ago and even though it's old, the bank won't give him a loan (so she says). He also had his tax return taken from him two years ago due to not paying his student loans and he up until a year ago had no revolving credit. My husbands parents just bought a house, but were only approved for $150k. After the dust settles from their home purchase they want to purchase my husband's sister's house and put it in their name (why didn't they do this before...). This has affected us so bad because we're forced to rent and he had to buy a new car due to debt-to-income. Everytime I log on to our bank account I'm forced to look at the mortgage. It has put a lot of stress on our relationship too. We want to buy a house next year but don't know what to do. We even have money saved. Any suggestions??? Additional Details She logs onto our bank account and makes the payments each month (I'm assuming through electronic check?). We tried that as well as a written letter stating he doesn't live there and is just renting it out and the lender still said no. |

The sister's mortgage DOES NOT have to be included in your debt-to-income ratios when you are trying to qualify for a new mortgage as long as you can supply 12 months of canceled checks from the sister showing she and her husband have been paying the mortgage. Your husband CAN'T be on the bank account that's used for the payments.
If she pays you and you then pay the mortgage then you're out of luck...start having her make the check out directly to the lender and wait 12 months to buy. |

The house either needs to be on your husbands tax returns as rent income and of course expenses OR you need to sell the house. If they can't buy it then someone else will. The prior year tax returns can be amended to show that you aren't in fact paying the mortgage. There would be no additional taxes as depreciation and interest would wipe out the income. |

If the house is in your husband's name, sell the house. If his sister cannot purchase it, then she'll need to rent elsewhere. |

Draft a lease to the sister. Give the lease to your bank. You probably will have to show canceled checks from sister, showing she is paying the rent. Bank should give you credit for at least 80% of the mortgage payment if you show it as a rental property. The longer the lease the better chance the mortgage underwriter will accept it. |

"Had to buy a car due to debt-to-income" does not make sense to me.
But, you asked for suggestions. Here's mine: It's your credit on the line, so evict them and let them rent elsewhere. The property is legally yours and they are tenants. Do what other property owners do when they want their place back - give them 30 days to leave. Then hose the place down and move in until you can sell it and buy another house.
Another idea: never let your MIL talk you into such nonsense again, and don't let her do your taxes, either. Face it: there is no free lunch. Pay now, or pay later. |

KL is right about proving they have made the payments for 12 months.. but they need to stop doing it through your bank. As for his parents buying the house, if they only qualified for $150k, they will not qualify for another house note... Best thing to do is have his sister make payments directly to the mortgage company for 12 months, get copies of cancelled checks each month & you should be able to buy then. Good luck! |

He can't, until the mortgage is paid off. Sorry., not the answer you want I know, but it doesn't change just because you ask the same question multiple times. And unless she can refi into just HER name so it's paid off, your chances of getting a mortgage for a home for yourselves is about non-existent, since you can't even get a loan for a used car.
And your husband CAN'T legally claim the interest on his taxes for two reasons, it's not his primary residence and he isn't paying it.
The "dust" won't settle from your in-laws home purchase to be able to buy the other house until they get their new mortgage paid down substantially, which will take many years. And if they could only get financed for $150K, not a chance they'd get financed anytime soon for a SECOND house.
Sorry, but you're screwed, unless your sis and family can repair their credit enough to get a mortgage themselves and refi. It's more than just the car repo messing up their credit, if it's years old. |
