Go to your local Citizens Advice Bureau for specific legal help, because they can look at your case in more detail.
But you have to give him notice before you can legally force him to leave. If he has paid a deposit, hopefully that should cover some of the loss if he does not end up paying you.
Sorry to hear you're having troubles though. It's unfair when people think they can live off of someone else for free :( |

In the US you must give him a Three Day Pay or Quit Notice and then on the fourth day file a court case. However, if you accept any partial payments you can't kick him out. You give him an ultimatim "All or nothing and get out!" That might not be the method in your country.
Get photos of him plonking and have him arrested. |

Legally, you have to get into the field of eviction which is actually pretty easy, but confusing. It requires a lawyer and proof of non-payment and in 60-90 days the judge will order the person evicted and the sheriff (in the US) will go to the place and escort the person off the premises. It's a messy bit, but there is a very black and white procedure which must be followed, or else that person will remain far beyond the 60-90 days.

If your in UK, then you have to issue a section 21 notice giving 2 months notice, then you have to go to court. You have not given enough info, does he have a tenancy? when did it start? You need to make sure you serve the correct notice, and in the correct manner. If you do not know how to start, go to the CAB.
But to be honest before anybody becomes a landlord, they should know the correct procedure of renting. |

Depending upon what state you live in there are Landlord / Tenant laws that you have to follow.
#1. Read the lease - has it expired and is he renting on a month to month basis.
#2. If there is no lease, it is usually considered renting at will and the laws will still need to be followed.
#3. Don't accept the rent anymore. I know that's hard to do, but if you really want him out "legally" don't accept the rent.
#4. Go down to your local Clerk of Municipal Court and file an eviction notice. There are usually two types. One (the quickest) is just for the Tenant to vacate without pursuing money damages. You can specify that if he wants to pay rent, he must pay it to the court and they will in turn pay you the money. The other is to file for an eviction with money damages, and since I've never pursued that route I have no information for you.
#5. No matter what, you need to file an eviction ASAP!!! Do not delay, the sooner you do it the sooner you will get him out.
#6. Alternatives that have worked for me. Give the Tenant an official letter stating that because of his inability to make rent payments in a timely manner you would like to give him the opportunity to get out of his lease - with no money being owed to you other than the forfeit fof deposit. It's Friday, so give him the weekend to move out and check the property Monday. I know you want your money, but what you really want is him OUT so you can get another Tenant in that WILL pay the rent.
Remember - File the Eviction TODAY!!!
Give him the option to move out even though you filed the eviction, and no... you don't need to tell him you filed against him. Make sure you tell him to call you and tell you he vacated. Tell him to leave the keys in a designated place, usually the drawer next to the refrigerator is a good place or if he's really lazy, leave the keys on the kitchen counter top. Drive by the place several times a day over the weekend to see if you notice any activity indicative of moving out.

happened to me a few yrs ago you would need to fill the form out and submit it i think the fee was about £45 and then he would be called to court to answer the case... notice starts after that |

Legally you have to go through all sorts of hoops to evict him.
I'd suggest finding a very obnoxious friend (or getting one to act obnoxious) and moving him in with him - the smellier and messier the better - and hoping that your tenant has had enough and leaves. |
