I replaced an old threshold (the part of the exterior doorway that weather seals the floor to the door, usually metal with a rubber gasket) I did this because the old one was rotting out and moving around and making things difficult. When I took the old one off I realized there was no repairing it so i decided to go ahead and replace it. It is relatively inexpensive, all together i spent aroudn $20 on the screws, threshold, and a few other items. Rent is due and i plan on dedecuting the cost of this repair from rent (inlcuding reciepts) but keep in mind that my landlord knows I am a good fix-it person and i usually fix things that are no big deal. But, this would be the first time I deducted cost of a repair from rent. How do I tell him instead of saying "hey i fixed this before telling you about it and now im taking rent off this month". Additional Details sorry i didnt make it known that I am not on a contract or lease! Legally I don't even live there but a gentlemans agreement was made that if I payed the rent by the first everything will be fine.
PS i have made my situation perfectly clear and the sarcastic responses are not appreciated. |

Oh boy. Most land lords would not have a problem with that. In fact it would not be uncommon to throw in $20 for labor also. But an after the fact announcement is not the way to win friends and influence people.
Here is what I think I might do under the circumstances. Call him up an tell him that you had to make a minor repair to the house and ask him to come over and inspect it to make sure that it meets with his approval. Durning the visit explain why you did it and how much it cost. Show him the receipts and ask if it would be agreeable to deduct cost of materials and a like amount for labor. The labor is your negotiating gambit. He will likely ask you why you did not call him about it first. You had better have a plausible answer. Such as "Oh, I guess I should have. I am sorry. It was such a small thing that it really didn't occur to me to put you to the trouble when I could fix it myself. Do you want me to call you in the future?" Something like that perhaps. |

Let's see...how do we break it to you that you CANNOT legally do that?
Unless you have a written contract from the landlord, not only allowing the changes but how much you can deduct from the rent, the landlord can consider the rent not paid in full, and can not only charge you a late fee, but evict you if you don't pay the balance due.
You cannot just do things like that to someone's property just b/c you feel like it.
Update: Here is to bettter answer your question...let's say that a branch caved in on the roof of the property and it was raining, water was leaking in by the gallons, and you couldn't get ahold of the landlord and called a roofing contractor that fixed the problem in the middle of the night, you paid the bill.
Sounds like a perfectly legitimate emergency right? To which you are entitled reimbursement?
Answer: Nope...that is what insurance is for...that is why you rent and don't own.
For such a small amount of money, he is probably not going to say anything, but to answer your question and be legally correct, the correct answer is you DO NOT have a right to make ANY deduction....you don't get to make those decisions for a landlord and the fact that he "isn't swift" doesn't get you a "pass". |

Pay your full rent this time and include receipts for the cost of supplies you used to do the work and ask if you can be reimbursed.
You have to look at this from your landlord's perspective. It's their property. Any decision to repair or upgrade is up to them.
Nobody likes surprises of this kind. In the future discuss your plans first with the homeowner or you may get a terrible countersurprise such as a lawsuit for unauthorized modification of a dwelling etc. |

It depends if you mentioned it to him before. If so and he chose not to fix it, you are right, if not unfortunately you can't withhold rent money, no matter how small the amount. |

I suggest you tell him you made the repairs and negotiate with him (or her) about how they will reimburse you. You cannot unilaterally decide to deduct it from your rent or rent of whoever lives there. If you just do that you are asking for trouble. Landlords are people too, treat him with respect and I am sure he will be reasonable about it. At least that's my 2 cents.

Pay the full rent this month......present the receipts in a letter requesting that you be allowed to deduct the costs from NEXT month's rent.......
most state laws prohibit tenants fixing things w/out warning to Landlord.....
And honestly, if you're worried about losing your "gentlemans' agreement" to live there.....just forget about the $20 bucks. |

Its only 20 dollars and if you have a good relationship presently with the "landlord" it wouldn't be worth it to mess it up, but I would mention that you fixed it and ask that if you fix anything else in the future if you keep the receipts to show him if he would be okay with deducting it from the rent. I would add that "I don't mind fixing different things. I'm sure it is easier than having someone else do it and I'm pretty good at that stuff, but 20.00 here and there adds up" that may open the door for you to say - Hey i have the receipts from the door I just fixed - let me go get them or you can do it next time you fix something or you will see that he isn't good with it and so then you know not to fix anything else. If you have a good thing going - it is not worth it to mess it up for 20.00. Because he may just not like the fact that you did it and then took the liberty to deduct it. - that could make him feel insecure with knowing what rent he will get and wonder how much next time, etc. -- get what I am saying. One other idea is give him the rent check and say - hey I hope this is okay but I wanted to let you know that I took 20.00 off my rent for the supplies to fix the door. I have the receipts if you want to see them, but if its a problem let me know. If it is - suck it up pay him 20 and be over it. |

Tenants don't get to make changes to the place they are living and then inform the landlord that they will be deducting it from the rent. You should have spoken about it first because it is not YOUR house. Not much of a gentlemans contract if you're not getting the ok from him to make changes to HIS house. |

Unless you had permission to make the repairs...you have no legal right to deduct from the rent. The landlord can sue you for making unauthorized repairs to the place. Read your local landlord/tenant laws...it's all there in black and white. |

You can not do that, the only time that you can do that is if you tell him about the problem and he does not get it fixed in a timely matter. Then you would have the right to fix it on your own and do that. But because you did not tell him that it was causing you problems, and did not give him the chance to fix it you may need to eat the cost.
What you may want to try to do is call him and let him know what was happening and say something like it was letting all of my heat escape everyday and my power bill is now huge so I figured that I would fix it as soon as possible and that is the reason I did not tell you. Would you mind if I took $20 out of my rent for fixing this for you so that I have that bit of cushion to pay my power bill this month? That I think would really be the only thing to save you here and even if you tell him that he still has the right to tell you no he needs you to pay all of it due to not allowing him to get the issue resolved. Talk to the guy and hope for the best, but know that he may tell you no. Good luck and next time do it the right way. |

You may be in for big trouble. You have no legal right to deduct those things from your rent. If I were the landlord and give you notice on the day I got your partial rent check. And then I would file in small claims court for the balance due. |
