Negotiations must always be done from a position of perceived strength.

For example, you have something I want, and I have something you want. Negotiation involves how much I'm willing to part with to get what you have, and how much you're willing to part with to get what I have.

Always start at a higher price than you're willing to accept, and don't reject out of hand a lower offer. Counter offers are the key - making the other guy feel like he has put one over on you, even though you got exactly what you wanted. Trust me, if they offer first, they will offer less than they are willing to pay. Hopefully, both sides settle somewhere in the middle at the end, and each feels like they've gotten a good deal.

Sometimes, it's not even about the money, it's about the negotiations. It's about giving a guy his "honor," and walking away with less than you really wanted, but allowing the other guy to save face. That can set you up for later negotiations, where you take advantage of the good will you have created...

Treat it like a win win situation for all parties - the point isn't to beat the other person down. What do each of you really want? Say I want a piece of property from a wealthy, elderly person with no family. He doesn't need the money - but maybe he would like a legacy and I can write the stipulation into a buy/sell agreement that I will name the shopping center after him. We both win.

Find what the other guy wants. Ask for the greatest amoutn of whatever you want to get and give out the least amount of whatever he wants. And bargain from there.

OK OK OK - let's start with all of that stuff above is kinda right and kinda wrong.

Here's what I mean - the advice from several of you is sound - Some of you idiot's need to really rethink if your momma really wanted to give birth to you or to an orangutan.

The best piece of advice I think no one up there stated was this - treat the other party fairly and remember that you are trying to reach a fair agreement. They want to sell this as much as you want to buy it - in some cases probably a whole lot more. They need the money to buy a new taco stand- or to buy a new taco - or to just get taxi fare - or whatever but remember they want this to happen to OK - so relax and have fun.

The art of negotiating is the art of creating a new friend. That's all your doing is making a new friend - remember that your friend may still crew you over so don't be a complete helmet wearing dolt - but relax and have fun -this is easy.

Oh and one more thing m- Be able to walk away from any deal - the one you can't walk away from is the one that you should run away from

The answer to your question requiresmore information. Depending on what you're negotiating, with whom, what your position is, what their postition is, etc.

The key though in any negotiation is to seek a win-win resolution. Start off seeking areas of agreement and work to find agreement.
