Not enough information. Generally you can't get a mortgage unless your name is on title. If title is in your name and mother-in-law's, she can Quitclaim the property to you and your wife. Are you buying property from her, did she make down payment? You want to take title as joint tenants with right of survivorship or tenants by the entirety. You should cnsult an attorney. |

You cannot assume a mortage from the mother in law. You have to quality for financing the mortage and the MIL will sell you the house for what is owed. Then the house is yours and the money your giving your MIL is no longer necessary -- You have your own mortage. YOU CANNOT ASSUME THE MORTAGE PAYMENTS AND REMOVE THE MOTHER IN LAW FROM THE DEED. If she dies the house goes to the person who it is on the Last Will and Testimony. |

I am assuming that all 3 of you are on the title and the mortgage is in yours and your wifes name. If thats the case, you would need her to sign a new deed removing her name from the title. |

She will need to sign the deed over to you. You can't do it without her signature. And I'm surprised the mortgage company lent you money on a house you didn't own. |

You will NEVER get her name off the tittle unless she signs it over to you. It makes no difference who pays the mortgage she is part owner. Based on another one of your questions you stated your mother in law gave you 70,000 to buy the home. Maybe your wife should look into getting a job to help pay that back or why not ask your mother in law to buy you out so you can buy your own home.
You need to understand that no matter where you live you will have to pay rent or a mortgage. Sounds as if you could not have got ton into this home if not for your mother in laws money which I am sure she did this for her daughter. You did not say how much of that 70,000 you have paid back if any.
I would guess none of it. The refinance has nothing to do with your mother in law since they are your credit card bills. Since your mil have many homes she can't be that dumb and I don't think she needs you to pay her bills as she could have rented this house. Not many people give away homes. |

If your mother in law's name is on Title then you need to have her sign a Quitclaim Deed which would take away any rights she has to the property. This isn't as easy as it sounds because usually the person doesn't want to give up their rights. Also make sure you have the Quitclaim taken to a Notary for signatures. |
