To remove yourself from liability for the mortgage you must:
1. Have another party who is on title.
2. The other party must be able to qualify for the mortgage on their own.
Some lenders will let you add or remove names from the mortgage after having the loan for a year or two. This does involve a form of refinancing your home. Check with your lender.
Sometimes they require documentation, sometimes they don't.
You do not have to give up your rights to the home and can still remain on title if you like.
A Quit Claim only removes your name from title and you are in turn giving up your equity rights.

Hi,
You can take your name off the mortgage by novation.
By a novation, I mean you can transfer the liability of paying off the mortgage to some other person. But you will have to request the lender to allow for it.
A novation is better than refinance as the latter may cost you a lot of fees which you"ll have to pay at loan closing.

I am not an attorney or a lending agent but do own some properties. And have gone through a divorce. I am not aware of any way you can take your name off a note short of paying it off. Give them the money you promised to repay.
I learned during the divorce that even though I had signed a 'Quit Claim Deed' which basically gave her the sole ownership to the house, that if she defaulted on payments to the note (the mortgage loan) I would still be liable for payments. Even though I did not have legal entitlement to it. Figure that one out. Didn't set well with me then and still does not set well with me. Luckily, she ended up selling the place and satisfied the note, ending any obligations on either of our parts.
You could see if the lender would allow a novation to take place, thereby getting you off the note. However, all parties to the original contract would have to be in agreement. And lenders tend to want to retain as many 're-payers' as possible on a note, thereby diminishing their risk position. Thereby making these somewhat rare. |

Refinance into another person's name through a sale. That sounds simple, but it might not be if you want to retain control of the property. If you are in the USA or Canada, I can probably help. |

By paying it off. Otherwise, it is unlikely that the lender will release you from all obligation. Even assumable loans where the lender approves the assumption there is still recourse to you.
You can sell the property. You can quitclaim off title to your family members. But the only way to get off that mortgage completely in the real world is to then have the new owners refinance in their own names. |

you have to have another persons name on title... such as your spouse/kids/partner....etc.... they would have to be on the title "deed of trust" for at least one year and then you can refinance out of your home loan into their name.... very simple... email me at ....apfagent@hotmail.com if you want me to do it for you.....thanks |
