I have lived in an apartment complex for 7 months. Have had no problems with any neighbors or management. Last week I got a visit from the police about 12:15 AM, just after midnight. They said my downstairs neighbor had called in a noise complaint because my children were still out of bed. My kids are 18 months and 3 years old. The officer agreed that they were not making any excessive noise that he could see.
At 10:12 last night I got another visit from the police. The same neighbor had called in a noise complaint because of my children.
They stay with me 3 days and nights a week. Their Mom works 2nd shift so they go to bed late and sleep late in the mornings. They are'nt running, yelling, crying. they're playing like typical toddlers. We have heard wood floors.
I am not on the phone to the police at 7 AM when this neighbor is outside yelling and swearing at her 9 year old.
How would you handle this neighbor? Would involving the landlord be helpful? Why or why not? |

Talk to the police about this person--after awhile, she will be fined for making a false report.
Also talk to the neighbor at your leisure. I wouldn't expect anything though. I've had experience that if they don't even talk to you before calling the police, that they aren't going to listen.
My similar story occured in my first apartment after college, and it wasn't in the best area. Since I was finishing college and had a boyfriend, I was at my apartment maybe a 5 days a week. I like to take evening baths to unwind. Every single time I would take a bath after 8 PM, the police would come to the door with a complain from my downstairs neighbor saying I was being excessive. Eventually she was fined. |

I would address the neighbor personally. Walk downstairs and explain your situation. Maybe she will be a little more sympathetic.
Also, does your lease require you to have area rugs? This might dull the noise.
If both don't work then I would involve the landlord. There is no need for the police to be involved. |

You need to talk to your neighbor. Explain that they are children, and that mom works late at night. Sometimes, all that is needed is a little empathy for each other.
Speaking of empathy, you have to understand where she is comming from. Either this lady is a total wack job-and if she calls again-report her when the cops come-or she is making complaints because the noise is out of control to her. Sometimes parents become immune to how loud their children are.
Young children should be in bed at a resonable hour-before 11pm. Good preparation for school and life! Being on the first floor is not fun, I know personally. You hear everything. But, you should expect to hear other people when taking a first floor apartment.
Another thing,you need invest in area rugs for your floor to keep the noise level down ASAP!. Also protects your floors and your childrens from nasty falls! If you have hardwood floors, your footsteps sounds monstrous, imagine tiny little feet that like to play around. I would imagine she wants to relax peacefully at night-as most people.

This doesn't sound like a good neighbor. Going to your landlord sounds like a good idea. The police will get tired of going out there. If not be prepared to get cited for noise disturbance. If so, and you witness her mentally abusing her child by yelling obscenities at the poor child please call the Child Protective Services through your local county Social Services Department in you area. They should be out so fast it will make her head spin. I think you should do this anyway. Because this parent is supposed to be a protector of the child, not an abuser. More, importantly they'll make sure her parenting skills are bettered. For the sake of the child. |

you have an issue that by the actions of the neighbor calling the cops have left little or no room to be able and sit down and talk sensible
though at the same time their are local noise laws and they do not have exceptions for young children, so you are going to have to deal with this situations, you mentioned the floors where hard Wood maybe able to get management to purchase through rugs to reduce noise
but you need to keep a log on when police are called maybe even have audio recording of the noise level when the police are called |

I know the police were out, but was there actually a report made and on file? If there is, then the landlord could evict you on a noise complaint. Other than that, the landlord is not going to get involved.
Next time the police are there, have them go and talk to the woman and explain to her that if she makes one more false call, she will be in trouble. Keep a log on what is going on and what happened and what was said by the cops at each incident. Then you can show the landlord the log if need be, also the court. Make sure you get the cops names and badge numbers.
In the meantime, get an area rug for them to play on. You know, like the race car track rugs I see in the stores. That may help. Noise limitations are usually 11 pm in most cities, so 12:15 am is a time to be sleeping for most people. The kids may be keeping the neighbor awake by thumping on the wooden floor or running their toys across the floor. And kids those ages really should be in bed way earlier than that. Try getting them to bed by 11 pm. |
