I moved into my apartment in the beggining of August. I payed my rent as required. The landlord agreed to keep the electric in her name untill I could figgure out a way to have it in my name ( I can not because of the fact I owe a outstanding bill because of fraud and Ameren refuses to work with me) After a while the landlord had the power shut off. I called Ameren to talk with them and file a dispute on my name and my mother allowed me to place it in her name for a while. Ameren told me my landlord requested that nobody got power in anyones name at my address. She also lied and said there was illgel tampering and so Ameren had to investigate and it came back that nobody tampered with anything. Ameren said someone has to pay the tampering fee and it has to be the landlord or myself and that is all on us. I do not believe I should be liable for that. I have been without power now for almost a month and I have two kids, ages two and six months. My two year old has asthma and requires a breathing machine so I had to spend $100 bucks on a portable power source for his machine and so I could atleast plug in fans. My neighbor offered to run an extension cord from her outside light to my living room so we had more power. The landlord came over, unplugged the cord. I opened my door and asked why she was doing this to us, she started cussing me out and yelling at me. I then closed my door, she forced the door back open and after trying to close it again she closed my wrist in the door and then as hard as she could she pushed the door open and the door hit me in the face.My two year old was right behind me and was close to being knocked over when I moved back after it hit me. I got into my car and went to the police station to file assault charges and they said they did not believe anything I was saying. She was on her way to calling the cops because I had the extension cord plugged in at the neigbors (with their permission) so im sure thats why they sided with her. They said it is illegal to plug in an extension cord and they would work on the case only after my mother went off on them for them not wanting to do anything about this.
My landlord will not only allow electric on in my apartment but she basically assaulted me with what she did. I did not pay my rent for Spetemeber because land of lincold adviced me not to untill she letg me get electric on.
In my downstairs bathroom she was suppost to have someone come fix the plumbing about a week after moving in and that still has not been done. I can not use that bathroom and have to use the upstairs one. She does not have batteries in the smoke alarms and I had to to that myself. This place is not livable and I plan on moving when I get the money together.
What would you all advise or have to say about this situation? Am I wrong or is she wrong? Additional Details My electric bill is in collections. |

Well, the electric situation is cut and dry. She can not prevent an electric bill in YOUR name, but she can prevent any one elses name, and should, as you are talking about committing fraud.
She does not have to provide batteries, just alarms.
And, also, yes, the extension cord thing would be illegal wiring. You could cause a fire.
I am not sure why you are not taking responsibility for yourself, but it is about that time. You have children. Get the power in your name, if that means paying your old bill then pay the darn thing.
There is no way that your landlord is "wrong", you sound like you do not have your act together.
I do not believe you about the power company, they would not listen to the landlord and refuse service to the occupant. They can refuse service to non-occupants, but not you, in your name.

I think you are leaving something out. You are asking us if you are wrong or she is wrong, but if you were in the right, you would know it and not need to ask us. This is why i think you are leaving something out. But if we had to go on just your side of the story, then of course everyone is going to think of you as the victim and the big mean landlord is harrassing you and you should sue them. But im sure the landlord has a different story, aye? |

Ok, everyone calm down.
First of all, I can't say what actually happened because I was not there. We're only hearing one side of it, and that's not a put down; it's fact.
If someone stole your ID, they must have used it for something else besides electricity. You should have the paperwork.
And it is against the law to plug in power from another home. So many things wrong with that it's not even funny.
I would think that issue should have been cleared up before your rented another apartment. It would not have been an issue.
Managers never want the power in their name, as then they become responsible for the payment. That's just common sense. Plus against the law.
And renting an apartment with a current plumbing problem is just not done. I'm not sure why you moved in without having it fixed.
I agree with another poster that there is more information that was not provided. Given that, I'm not sure what I can suggest, as now you have a possible eviction notice on your record on top of the forgery.
I would give her notice on the apartment, pay up what you owe and go live with your mother. Then get your paperwork together and go see an attorney.
And never get into a shouting match with anyone. Do your homework, get everything in writing and never rent unless you're sure there are no problems with your credit history. |

You can just not withhold rent because you feel the landlord is treating you wrong, or even if you are being treated wrong. You have to notify the landlord in writing of the issues at hand, allow 30 days for the landlord to responds, and then place your rent in escrow until the issue is resolved. Simply not paying your rent because of the issues will look like non payment, if your landlord takes you to court you will be evicted, because you have no evidence to support your claim. The judge will not listen to a thing you say. |

If you are required to have the electric service in your name, you are in breach of the lease. You made the rental uninhabitable. I'd evict you just for that. I'd also call social services since NOT having electricity is neglect of your children.
The owner has no obligation to leave the service in her name. If you could not get the electric service in your name, you should not have moved in, period.
The landlord has every right to inform the electric company of the current tenant's name to prevent fraud.
The electric company will not let the service be turned on because you are the legal leaseholder and owe them a balance due.
That is their policy.
Your mother's name is NOT on the lease, so she cannot have the power turned on in her name.
You don't pay the balance due, you don't get service in the future. This is your problem and NOT the landlord's.
If the electric is turned on in anyone other than the lease holder's name, then the landlord has just acquired a new tenant, which the landlord does not want.
You do not have the right to withhold rent. The landlord is not the one preventing you from getting electric service - the electric company is.
Since you owe the electric company money, this whole issue is your fault. The landlord is not required to fix issues which are caused by the tenant.
It is a fire/safety/health hazard to run an extension cord from one apartment to another. You put the landlord's property and all other tenants at risk when you did this.
If the landlord is paying for the electric for the outside light, you tampered with her electric (and are responsible for the investigation fee) and were stealing power. Common area lights are normally paid by the landlord.
Smoke alarm batteries are the tenant's responsibility. The landlord provides the alarm - the tenant provides the batteries.
You have a working bathroom which can be used.

Call your local health department and have them inspect the apartment. There are a number of items you list that could be against your locality's laws and the health department can require that the landlord have them fixed.
As for the rest of it, a consultation with a lawyer might be a wise thing to do. |

Just My 2 points worth, but my tenants "couldn't get the electricity in their name without paying a "$350.00 deposit " " They stopped paying me their electricity after 1 month and ended costing me thousands, No Christmas for my family, or them, as I threw her and her 8 year old daughter out on Christmas Eve. ( that was after 2 month's of sob stories) Charity or Business ,who ya doin' business with ? There's more stuff to the story on both sides but bottom line is if you order a Happy Meal you have to pay for the Happy Meal. |
