Husband will not pay rent am I responsible?
My husband signed a written agreement that he agrees to pay half of the rent for our home until our lease is up in January 2008. I said he can come and go as he please, but just pay his half of the rent by the due date. He has not paid any rent and now me and my children have to move because I can not afford the rent. Check with a lawyer that practices family law; you are likely entitled to some support for the children.

you must sue him in a court of law which can not be done as a wife but you can in a divorces.

Does it really matter if you're responsible for the rent or not? Because, if the rent is not paid, no matter who is responsible for it, both of you will get evicted.

Question back to you, who name or are both your names on the rental agreement? Verbal agreements in court end up being a he said / she said and the judge will base his or her own opinion on who he believes most.

Well i dont know this for sure but check into it. Who's name is on the lease? If it is both of yours names then both of you are responsible. Then what u would have to do is take him to court for his half if you have a written agreement he will be ordered to give u the half u have been paying back. So unfortunately there really isnt alot you can do. I know some goverment help is available but you would have to qualify for it. You could also talk to your landlord show them the written agreement and see if they will get involved on collecting his half. Also i dont know your circumstances but it sounds like you guys are seperated????????? if you are and the children you have are from your marriage with him i know in florida there is things u can file for like afdc until you get divorced to help pay for things with your kids and he would have to pay that money back. i hope this helps like i said i dont know your situation but i have been where you are but it was when i was going through a divorce. good luck best wishes.

The agreement should have been between the landlord and your husband, not between you two. Your agreement may be enforceable in court to recoup the money owed. If you are on the rental agreement then you are liable for it!

Well, he should not have to pay it if he is not living there. If you sue, they will only give you the money for the months he stayed in the home.
