I'm breaking my lease. Can they make me pay anyway? And how?
The landlord and I had a "gentleman's agreement" that the one year lease could be broken if I decided to get married within the lease, which is the case. Now they are saying I have to fulfill the terms of the lease and pay.
Also, incidentally, the stove never worked, the dishwasher was broken, and they promised a space heater in the den, which they never installed. I was there four months, on a lease of a year. With the promise that the lease could be broken whenever I decided to get married and move out, which is what has happened.

verbal agreements never work. it will say in your lease paperwork how you can break the lease and the terms of anullment. i would go through that and see if there is a way to break it with out paying. you can also go to the city and county to see what the rules for a renter are like in colorado they have to paint and shampoo the carpet and you can break one with a months notice i think. good luck

if your lease agreement(the one that you signed) stated that you could leave if you got married, then you are fine...but if it were only a verbal agreement...then you will have to fulfill the contract terms!

Did you sign anything? Like a contract, rental agreement..

All the problems in the apartment, unless you made written complaints, with copies, can be blamed on you and you could lose your deposit. But, did you really ever expect that back?

If you really think you are going to be obligated to fulfill the lease, talk to a lawyer. But if nothing was signed (and I want to think you signed SOMETHING..) this really won't hold up in court. What kind of rental agreement says you can't get married??

Yes, you have to pay. All they have to do is drag you into court and show the judge where you signed the lease. There is no such thing as a gentleman's agreement.

And you are right....the stove, dishwasher and spaceheater are incidental. They have no bearing on whether or not you will have to pay for your lease.

It's hard to tell without looking at your lease. Also, landlord-tenant laws vary from state to state.

If your landlord sues you to enforce the lease your defenses are:
1. Your landlord and you had a verbal contract in addition to the written lease;
2. You are entitled to break the lease because the place was not habitable due to the broken stove, dishwasher etc. This will hold even more weight if you can demonstrate to the Court that you asked your landlord over and over to fix these things but they never did.

In some states, the landlord has a duty to mitigate damages. In other words, they have an obligation to find a new tenant rather than just suing you. For example, say it's a 12 month lease, $500.00 per month and you leave on January 31, 2006 after only one month. The landlord finds a new tenant who moves in on April 1, 2006. This means that the landlord missed 2 months rent and your maximum liability would be $1,000.00 ($500.00 for February and March) Check with an attorney in your state who is familiar with the laws.

Everything depends on what you both have in writing that you signed.
The lanlord and you have to have something signed by the other as proof. If you signed a lease agreement check the small print and see what you actually agreed to, if you signed to say that if you left before the lease ended you would pay the remainder of the lease then it does not matter what has been said it has to be in writing so you have proof.
If you have photographs and again a promise in writing the improvements would be made then you have something to bargain with if it is just a verbal agreement then you may as well forget it.

The landlord can take you to court and get the courts to take money owing out of your wages if need be

You have to prove the conditions & agreements you had with the landlord and word of mouth wont be considered you need evidence to back it up

Okay first to address the easy issue, the stove, the dishwasher, and the space heater had to be in the original lease for it to be covered. And from personal experience of an eviction when I was a young guy, I would say that wont hold much water either way, (we complained to the judge that we were without water for a substantial amount of time).

If it was a gentleman's agreement as opposed to a written agreement it is your word against his. You could fight it in court. I just dont see your chances as very high at winning it because most judges love to see what is in writing :( sorry wish the news was better & good luck!

Yes, signed contract has more value in this world then verbal agreement. You might sue them for not fulfilling their end of the contract and providing everything you need for living. But if you broke contract, yes they will make you pay if you won't fight back. Oh, yes, lease should say what they provide for what you pay. Just look at it, if anything is different, like you said stove never worked, dishwasher broke, and its on the lease then they violated contract, and it is VOID means it has no value and you can do whatever you want because you are no longer under contract.
