Well there is a process for that in which eviction papers must be served,if this has been done already the judge will probably ask her what she has done to help herself,If she has done nothing they probably will give her 2 weeks to leave and find another place,if she still cant help herself,they will take her child until she can find housing and maybe set her up with organizations to help her get on her feet.it all depends on her situation. |

If you are going to Court, be sure you have the necessary paperwork. Your rent receipt book, a contract if any. Sometimes the Courts may have an arbitrator step in instead of the Judge. As they haven't paid in three months, all you will need to do is simply state your case. I am taking it for granite that you did give to the tenant a notice of eviction for non payment of monies due. You will need to bring that copy to Court with you.
If all is in order the Judge will issue a possible stay for the tenant for about 15 days due to the fact that a child is involved. A stipulation will be that she leaves the premises before or no later than the fifteen days. It will be a Court Order. You will be able to charge her for the additional time. Then you go back to small claims after your total damages, past rent due and anything else owing. Again, paperwork is everything, and also pictures of any damages.
Just a suggestion, but next time don't wait so long if you want them out. There is such a thing as a 3-day eviction. Something you might want to look in to for future reference. I don't mean to sound harsh but you have a rental business to consider. Your tenant can receive help from all sorts of agencies because she has a child. |

Hopefully, you have filed on the tenant and this is the court date... if not you will file on her and they will set a court date. Where I live you go to court and meet with a mediator if they are unable to help you then you will go before a judge. Make sure that you have all your paperwork ie: lease, late rent notices, 3-day notice. Also, some judges will ask for the city inspection that is if your state requires it... You will win if she hasn't paid its just backing it up.. she can't say that she paid if she doesn't have receipts or anything... when you are done you will file for the WRIT which can be served by the sheriff for a small fee usually around $40.00 (charge the tenant with all the charges that you have to pay out of pocket- the writ, court filing fees, copy fees...etc. Ask in your state if you can file a money judgement as well...it will help you get your money) This usually take a few days to get served and they are given 72 hours in my state to move IF they don't move out and decide to stay.... in my state you go in with the sheriff (they will set a time and let you know when it is... after the 72 hours and move all of their belongings to the curb and they are then removed too...FYI buy a lot of garbage bags! I a not a lawyer and I am not sure what state you live in but I know as a landlord that sometimes the judge may give the tenant extra time to move out or may just tell them to move out right away. In some cases I have seen the judge does not care if they have no place to go. And they do try to play upon the judge and the landlord whether they do or do not have another place to go.
I know I am not much help - But I hope you go into court and be strong. Make sure you have all your proof with you.

I am going to assume you have or you wouldn't have a court date.
I hope you have a signed lease. If she has not paid in three months, you should not have a problem getting her out. IF all your paper work is in order you will be O.K. Here (MI) the judge would ask her WHY she hadn't paid and give her a chance to talk. Then, they usually give them another ten days to get out. It all depends on what your tenant comes up with. She can play dumb and say she didn't understand and has no where to go.......
She can say she isn't prepared and get it postponed.

You have to feed your kids. Just wanted to let you know that if you allow the tenants to walk all over you, it'll be a headache. What you need to do is when the rent is due and they haven't paid, make sure they get their 5 day notice right away and then file an eviction right away. Even if they pay you, now they know that you mean busy and they won't push the limit |

They will give you/her an official letter of eviction for 30 days notice. At the end of the 30 days, you will be allowed to enter that property and have all of her things thrown out and change the locks. That is your legal right. |

if you were in my country, a six months notice is safely required before she can move out. ofcourse the last six months of her rent. but other ways are helping oneself, arrange the area boys to pack her out before she knows it. perhaps you are in europe where rule of law takes over another man's property and laws are quoted giving reasons why she should continue to stay in a house that is not government's. take it easy anyway, talk with your lawyer to arrange something. |

I haven't been to court for this type of thing, however I watch the court t.v. shows like there is no tomorrow. They will ask the lady why she has not paid. Her answer might be something like "I don't have enough money" or "because I don't feel like it"... either way, not paying rent and trying to put YOU through a guilt trip for wanting to kick them out is just PURE ignorance. You need to bring documentation, so it's not just purely your word against hers. She might try to lie and say "I have paid my rent! she is just trying to kick me out because she doesn't like me"... make sure you have clear proof she has not paid!
Anyways, most likely the judge will tell her "you need to pay her the three months rent!" and the judge will tell her that she needs to pay the money she owes you PLUS that month's rent by a certain date or move her stuff elsewhere. I'm sure that if she doesn't leave you can sew her for something. If she has half a brain she'll either pay or go. |

Why don’t you see if HUD can help the family. You won’t get paid much rent but it will be better than nothing. You could even be their representative payee for the rent. If she over 65. She would automatically qualify for SSI if she has no income. I myself would try to help out the family first before kicking them out. |
