It sounds like you move, and thats about it. The thing is, just because there are problems with an apartment does not mean that you get to just stop paying the rent. You could have paid the money into an escrow account to force them to fix the issue, but it doesnt sound like you did that. And since you didnt, you're out of luck. Two wrongs dont make a right, and you're going to be evicted. Sorry, bear it in mind next time. |

Not paying rent because of repairs is not going to work. Anytime you have serious health issues with a landlord like the ones you described you need to put it in writing and state that you need him to address the issues immediately. Depending on the state you could possible do minor repairs like extermination and deduct from rent IF he failed to address your issues in a timely manner. However, staying there and not paying rent only hurts your case. have you informed him of these needed repairs in writing? You do have remedies as a tenant for repairs not done, but there are procedures. Seek legal advice |

I notice you didn't say you weren't paying rent because of the poor living conditions instead you excuse and justify not paying the rent by telling us how bad it is. So are you telling us its OK for the asbestos, rats, roaches and sewer backup as long as you don't have to pay rent? Or are you just trying to excuse your not paying the rent by pointing fingers AFTER the landlord said pay up or move? I suspect the latter.
I can give you a good idea how it will go in court

Judge - did you notify the landlord, do you have proof of notification and did you advise the landlord that you would withhold rent if these things weren't fixed?
You - ummmm, no I just whined and expected sympathy on an anonymous internet message board
Judge - if the conditions are so bad, why are you so anxious to stay that you are fighting eviction?
You - errrrrr, well ummmmm

The landlord does need to address those issues but you still have to work within the law. Waiting til you have been served with eviction papers to complain about the lousy living conditions is a little late and more than slightly self-serving |

Sounds more like you are not paying rent because you just do not want to.
How are you qualified to determine an asbestos problem?
Most homes have ratd and plumbing problems...it is part of life.

I would just find another place to live and move out. Oh and I would call the health department to come over and investigate your complaints. If the landlord threatens you again, tell him you have already called the health department and filed a complaint. |

you can withhold rent but you have to escrow the money and document document document all of your complaints photos, witnesses etc adn then make copy of the evidence contact your local net office and have them do a walkthrough they'll put that landlord in his place |

You won't have much luck unless you can show that you notified the landlord in writing.
It will be advisable if you call the department of health and let them know of the problem. You can write to them detailing the inhabitable living conditions and keep a copy for the courts.
When you go to rent elsewhere be sure to take these with you, having an eviction on your credit makes it almost impossible to rent anywhere.
Oh yeah, if it does show up on your credit report, you can send copies of the letters along with a cover letter from you stating the circumstances surrounding the eviction. Those letters can help your credit problem.
If their is a possability of the problems being remedied, you owe that money....don't spend it....save it so you can pay when the time comes. |

You should write a letter to the LL specifying the issues. You can call code enforcement and they will help you handle the problem if the LL is in violation. If he/she is not in violation and doesn't fix these things you still need to pay, but should leave. Sounds like the place should be condemned, but you won't know unless you call code. You have to pay your rent or you will be evicted and that can cause you a host of other problems when trying to get another apartment. My suggestion is to be more careful and pay attention to the area, detail, and LL who will be renting your next apt. out. You didn't catch onto any of this before you moved in? |

First make sure you take pictures of the rats roaches ect. because then if taken to court you'll be able to prove it and they might deduct some or all of the money you're owned. If you're in a month to month tenancy ( no lease ) then you have to give thirty days notice before moving out unless you can prove that the place is uninhabitable. I watch judge Judy and I see people who have pictures and they don't have to pay. |
